Police: Pizza Hut Employee Kills Robbery Suspects

Man Pulls Gun, Fatally Shoots Two Men

POSTED: 10:53 am EDT September 28, 2010
UPDATED: 11:24 am EDT September 28, 2010

CHARLOTTE, N.C. -- Charlotte police said Tuesday that a pizza restaurant
worker who pulled a gun and shot and killed two robbers will not be charged.

Police are searching for a third man who they say got away from an east
Charlotte Pizza Hut restaurant.

Investigators said the robbers burst through the restaurant's front door
late Monday as two workers were cleaning up in the back.

Police said the suspects ordered the two employees into a walk-in cooler,
then started beating one of the men. The other employee pulled a handgun and
opened fire, police said.

Police say they found two handguns near the dead suspects. Their names have
not been released.

Chris Rickert says these things don't happen.

Lord I've seen the light! No need to have a gun when I can carry zucchini!

FRENCHTOWN, Mont. (AP) -- Police say a Montana woman used an unlikely weapon to fend off a charging bear -- a zucchini.

Missoula County Sheriff's Lt. Rich Maricelli says a 200-pound black bear attacked the woman's 12-year-old collie just after midnight Wednesday on the back porch of her home about 15 miles west of Missoula.

When the woman, whom police did not name, screamed to draw the bear's attention, it charged her and swiped at her leg.

Maricelli says the woman jumped back into the doorway and reached for the nearest object on her kitchen counter -- a 12-inch zucchini from her garden.

The woman flung the vegetable at the bear, striking it on top of the head and causing it to flee.

Maricelli says the woman did not need medical attention. Wildlife officials were trying to locate the bear on Thursday.

Do you suppose antis will say she was 'compensating?'

In the above quote, I have a real problem with the way this statute is worded.
it is very vague and I feel that If someone were ever forced to defend myself, that they MAY BE FOUND GUILTY if the statute is interpreted as written SINCE IT LEAVES NO CLARIFICATION ON PROPERLY PRESCRIBED MEDICATIONS!

Oh I've got a better one. With good pain meds I can see someone getting loopy and possibly effecting their judgement. What about me? I have ADD and I treat it with Adderall, helps me focus at work and generally keeps my head clear. I don't take much, but with the way it's stated above, even a tiny bit of it could be bad. It is an amphetamine and a controlled substance that when taken properly can actually HELP you think more clearly.

940.09 Homicide by intoxicated use of vehicle or firearm
(1g) Any person who does any of the following is guilty of a Class D felony:
Causes the death of another by the operation or handling of a firearm or airgun
(a) while under the influence of an intoxicant.
(am) while the person has a detectable amount of a restricted controlled substance in his or her blood.
(b) while the person has an alcohol concentration of 0.08 or more.

it is very vague and I feel that If someone were ever forced to defend myself, that they MAY BE FOUND GUILTY if the statute is interpreted as written SINCE IT LEAVES NO CLARIFICATION ON PROPERLY PRESCRIBED MEDICATIONS!

For instance, lets say a guy/gal is being treated for chronic pain due to injuries, if he is legally ingesting an opiate medication in accordance to the doctors orders. An Opiate pain treatment medication can be classified as an intoxicating substance, So just because a detectable amount is found in a persons bloodstream I would expect the prosecutor to say that person was abusing prescription medications and try to portray that they were intoxicated from it.
Scary!
So because you had intense dental work, this could get you charged with a felony for an otherwise justifiable shooting due to the wording of the statute.

I think the keyword here is "restricted controlled substance", as in if it is prescribed to you legally, then it is not restricted, or it has not been restricted for your use in accordance with your prescription. At leat that would be my thought if I sat on a jury.

But you'd be likely sitting in a jury with liberals from Madison who would out number you...

Dane County DA: Ladies and Gentlemen of the Jury, through the course of this trial we shall prove to you that Mr. Stoppedsomebadguy clearly had no legal right to defend himself as he was taking legally prescribed pain killers! Now make no mistake, the defense will argue these pain killers were legally prescribed BUT THATS NOT THE POINT! THIS MAN WASN'T FEELING PAIN, SO WHY WOULD HE NEED TO DEFEND HIMSELF IN THE FIRST PLACE! It is your DUTY as sheep-errrr MEMBERS of the Jury to convict this man!
