Really bad LEO encounter!

I don't hold it against them; this is probably something they've never encountered, and had no idea what to do.
They were just misinformed LEOs in a strange situation.
I'm hoping to resolve this soon, I'm about to get a new carry gun.

One thing that I thought strange. The Chief told me that I should just go and get a CPL (CHL?), when he knew exactly how old I am. :? Wut?

It's a Louisiana Concealed Handgun Permit and you have to be 21.


Tell him to get the Sheriff to give you one for the Parish. :D

Of course the police would rather not see a gun openly displayed but in your case due to your age that is not possible, I suggest that you send an email to the chief telling him that you understand the circumstances which caused the unfortunate situation and that there is no hard feelings.

I also suggest that you learn were the school zones are in your town so you can avoid them, if your town has a local newspaper maybe you can convince them to run a story on open carry so the local residents will be more aware of your right to open carry, that way they will not call the police and report that there is some crazy guy running around with a gun...

Then the Chief said they ID'ed him and he was alllowed to be on his way. :?

Charlie..whatever the circumstances, Nikki now has the Chief of police saying that they acknowledge his right to open carry..I suggest that he be magnanimous in his victory and make sure that in the future he breaks no laws while open carrying as he will certainly be watched....

I have said before..while its legal to open carry not all people can own a gun or carry one..felons and some other people are prohibited..once the police become involved they can and will check you for prior arrests etc...that might explain why he was detained for a period of time...

The police may have been checking on the open carry laws themselves etc..any number of things may have been taking place...but the situation was resolved without an arrest at least unlike what happened to Mark...I would say that Nikki learned something and the police learned something...no harm done....

On a side note..when I emailed the commander of the 8th dist police, Major Hosli and his second in command Lt Selby on their views on my right to open carry neither man replied to my emails even thought they openly told residents to email them with any problems they might have.

I had to go to neighborhood meetings and force the issue in front of a crowd of people...after I made my desire to open carry known at these local meetings several of my neighbors stated on a nola.com forum that they would call 911 and report me as an armed man walking around their neighborhood every time they saw me open carrying. This is why I got my concealed permit..out of concern that some sort of situation would happen.

The neighbors who made the claim that they would call the police everytime they see you walking about armed would knowingly be making a false report since they are clearly aware of who you are and your stated purpose! I would contact those very neighbors and tell them that and then open carry in front of them.

After all, they actually stated they would make MWAG calls in an open meeting so they they fully know they would be making a false 911 call.

Open Carry in Louisiana is Legal under Louisiana Revised Statute 14:95.

Open Carry into Stores that do not sell Alcohol for consumption on-premises is Legal under Louisiana Revised Statute 14:95.5.

One only consents to Stop and Seizure, although Illegally and Unconstitutionally, whenever He enters into an Establishment that sells Alcohol for consumption on-premises, under Louisiana Revised Statute 14:95.4.

Not correct...

Open carry is a RIGHT under La. Const Art. 1 Sec. 11

14.95 is the legislature exercising it's constitutional authority to prohibit "concealed on the person" carry, which is the reason one needs permission. This is a good example of the legislature acting on express constitutional authority, as opposed to assuming the authority(incorrectly) as in "gun free school zones" etc...

To "estcrh", it should be stated as "certain felons", not "felons". Because some felons can own/possess/purchase a firearm. (just saying).

I should have said..people convicted of certain crimes...as non felony domestic violence is one of the crimes that would keep someone from owning a gun, there are some other non felony crimes also probably.

The idiots who said that they would call the police if they saw me open carrying did it on a nola.com forum...anonymous...due to the invisible unmarked school zones in the Quarter I do not want to give anyone the ability to put me in the position were I would have to defend myself against a charge of carrying in a school zone...it sucks but thats how it is...

It seems as if these officers were very desirous of seeing you put in jail. As you have related it, it seems very likely they were just looking for an excuse to do so.

Doesn't the fact that you were not arrested when so many officers tell you you were breaking the law tell you something?

Because, I'm pretty sure if they weren't completely full of BS.....

...they probably would have arrested you?

The very fact that you were let go tells the world all it needs to know:

You are an upstanding, law abiding citizen. The fact you weren't arrested confirms this. Any effort by officers to convince you that you were breaking the law rings hollow.

I sent an email to Chief Ford myself. It included his reply to estcrh, and my own reply. I also included the applicable laws and statues as well. It was sent last night. No reply.
I think I might send it again tonight.

I was stopped by one Officer, he radioed in. Three more cars come zooming around the corner with their lights on. I live no more than a 5 minute walk from the Police Station.
The Deputies showed up as I was being taken back to my house, which was no more than a quarter of a mile, and around the corner from where I was detained.
I asked them why they needed so many officers. I was told that they needed them because my situation was something that thy had never encountered before.

I didn't think of it at the time, but if the Chief knows who I am and knows the laws; shouldn't he tell dispatch and the officers that it's all legal and squared away?

Luckily, there are no school zones in my town. The schools are about 5 miles down the highway from where I live. I might do the newspaper thing if I can get an appointment with the editor. I'll have to call them.

Nikki, I think by now the Chief has more than enough copies of the laws and status emailed to him. The chief to his credit has admitted that you have the right to open carry and unlike the commander of the police were I live he says he supports your right to open carry...I would be willing to take him at his word....

It would probably be helpful if forum members emailed the chief and thanked him for acknowledging this..I already emailed the chief and thanked him for his quick reply...I do not think you have anything to gain by holding a grudge etc....unless you have similar problems in the future. If a resident of your town did call the police and report you then the police have to investigate...Consider yourself as an representative of open carry in your town...

This is what I sent you and it is the bottom line. This young man is well within the Law and it is his right to carry. I hope everybody understands the residents of this Town do not see this everyday and some education will be needed and provided to them. I hope everybody also understands we, the Police have to respond to every call by our residents. Often when they call, they do not wish to give their name as was in this case. We just got the call that someone was walking down a street with a gun. The Police arrived identified the individual and when it was determined he had broken no laws, he was free to go. The young man has no problem with the police department.
