It is nice to read that "common sense" prevailed and not the tortuous logic generated by the ADA.

Does this also free up the "hold" on your CCW application or do you have to re-apply? Will they expedite it since it has been in their hands for much longer than the period allowed by law?

Congrats from WA Krista. Sounds like when you sue them for violation of your rights under the "color of Law", you need to go for the cost of a new pistol as an add-on...No?

Krista answered that in this thread or a parallel one. They returned her application as incomplete - it wasn't. The form has changed - she will be reapplying ASAP.

there are still points of concern i have for the young Lady:

i believe they siezed more than one gun. they all should be returned.

Will her credentials, including her Utah stuff now be reinstated?

Just a thought -

While Krista has been pushed, pulled and generally forced into the public eye against her will, perhaps she may be inclined to "go public" - you all could do worse than to have her as a speaker, promoter of your RKBA and as a member of a "lobby team" before your state and local governments. She is articulate, well versed and knowledgeable with just the right temperament.

Hope to hear a LOT more from MKEgal.

Pretty much. I was trying very hard not to cry in relief (& failing).

It was returned for supposedly being incomplete (it wasn't); I received it the same day the DA told my attorney that I would be charged with ccw.

Took it back this morning, talked with a supervisor in the processing department, she looked it over & confirmed that everything is in order. She said it will probably be 'data entered' tomorrow.

Except that I strongly dislike public speaking, hate being the center of attention, really hate having my picture taken in any way, and have come to extremely distrust reporters.
When forced into any of the above, I seem to manage to cope OK, but I try not to seek it out. (Though I have gone to several legislative hearings & suchlike to voice my opinions about various bits of the carry laws, including one this morning.)

Many who don't like or fear public speaking actually do a FINE job.....because they are worried about making a mistake and so they plan, prep, practice, and then whoooop booty when they get up there and face thier fears.

I'm sure you'd do well.

Also thought about making a blaze orange holster, even including reflective fabric, so nobody could ever again claim it was hidden.

Do we have any idea what the thinking of the jury was? Did it reject the Walls doctrine or simply think it didn't apply to this set of facts?

A couple of comments that "The system did not work.." - The "system" generally does work. It just that about 50% of the people don't like a given result. This was a positive outcome for MKEGal. If the system doesn't work does that mean you think a "guilty" verdict should have been returned?

A defendant is not found "innocent" - usually "guilty" or "not guilty" are the choices. She was innocent (widespread opinion) but judicially "not guilty." Precision in language is important.

While not relevant to this case, there are many times when property is not returned despite a judgment of "not guilty." Contraband is an obvious example but there may be questions of ownership or a civil forfeiture related to the criminal case.

What basis is there for a civil suit/civil rights complaint? Under the law of the Wisconsin and the latitude given law enforcement, the arrest and prosecution were not unreasonable. The law and MPD policy need to be improved to avoid a repeat performance. An explicit legislative repeal of Walls would be a good start. Police departments (or rather their municipal employers) have shown a willingness to risk paying out $K for vacuous disorderly conduct charges (at least pre-Act 35). What incentive do they have to avoid arrests under the Walls doctrine? Anyone? Anyone?

Whatever the disposition of the defense fund money, I caution MKEGal to make sure she complies with any tax liabilities. I do not know if there would be any for leftover funds but I would not give prosecutors another opportunity.

Finally...Is there a method to change the display of posts to reverse chronological? Readers shouldn't need to wade through years old stuff to get to the breaking news.
