I suppose I should have given the officer the chance to notice my firearm and taken the risk of him becoming hostile.

Some of you are arguing that I shouldn't have "let" him disarm me. How you suppose I prevent that? Should I have grabbed his arm? Maybe pushed him out the car? My window was already down at this point so maybe I should have rolled it up? Reached down and made some strange movements as he was approaching my vehicle?

I'd like to know so I can handle it better next time.

Although I have already used the tactic, I did not think about the cracked window in the context of preventing a temporary gun seizure when it was first asked why he allowed the gun seizure.

My first thought was to refuse consent verbally (but allow the seizure).

But, your post kinda highlighted something for me. The first decision is whether to exercise one's rights. By even mentioning the gun, the OPer, in a sense, allowed the seizure.

Oh... Something; something about an RCW, maybe a number like 9.41.050 and it requiring a concealed pistol license for loaded vehicle carry. :p

Oh wait or was it I needed some hiking boots, poles, with a day pack for vehicle carry, I'm hiking from my house to the car, driving into town to hike from my car to Safeway, hiking around inside Safeway, hiking back to the car, driving back to the house and hiking from the car back to the house all without a CPL. RCW 9.41.060 (8)

Having a firearm duct taped to my forehead and loaded with my CPL does not rendered it concealed. It is simply a licensed activity.

Only open your window enough for you to hear each other and to pass paperwork. If your window is down when he pulls you over, roll it up and get your forms out before he gets to your window.

I'd wouldn't do anything but turn off the vehicle, turn on the hazard lights, turn on the interior light put my hands on the wheel and wait until the LEO gets to the widow. I'll only get documentation out when it is requested and only offer it through a slit in the window.

I think there is some rule in rhetoric, going all the way back to Aristotle, that the words duct tape in a counter-argument just destroys the opposition.

I am a little dismayed to learn that duct taping your gun to your forehead is now a licensed activity. When did that start? :p:)

Well, in WA it is only when the pistol is loaded. It is still legal to duct tape an unloaded firearm to your forehead while in a vehicle.



p.s. BMG there is no definition of 'concealed'in our RCWs, therefore we would use the plain language of the law via Blacks Law Dictionary:(note: it says nothing about a vehicle)

The term “concealed weapons” means weapons willfully or knowingly covered or kept from sight. Owen v. State. 31 Ala. 387

for most of this thread.... tho now I'm curious to ask, for those who suggest this course of action when getting pulled over, what would you do in a vehicle that lacks windows and doors? Especially while OC, or duct taped elsewhere....

Does the firearm have to be holstered while duct taped to you forhead, and if you look at someone the wrong way, couldnt that constitute a threat?
