You should shoot. You don't know what the criminal is going to do. If it is my life or his, I choose to protect my life. To make this a little more understandable, Tate & Daniels were part of a group of 4 that robbed a home. Homeowner, said the suspects forced their way into his home, one of the suspects had a gun. Homeowner struggled over the gun, was able to access it and fired the gun one time. The bullet struck Tate in the groin, he died later. Since Daniels was involved in the commission of the crime, he is also responsible for the results, in this case including a murder homicide, the same as if Daniels had shot Tate personally and intentionally.Man charged with felony murder after man shot during robbery
Instead of trying to wrestle the firearm away, it would have been easier just to defend yourself with your own firearm.
