IIRC, the US constitution was written before militias were formed, so how was it meant for militias?

You may be defining "militia" incorrectly. The broadest definition is a body of armed people of the same social or political group. Militia have been around since . . . well, since man has equipped himself with weapons and banded with other men for social reasons, including to fight other men. That is to say, militia have existed since time immemorial. Also, militia may "form", but they also may merely "exist". There is such a thing as "organized" and "unorganized" militia (those concepts are even in writing in US law).

Thus, the US Constitution was written well after many militia, indeed innumerable militia, had existed and were in existence at the time.

Now, if you are referring to the 2A in "how was it meant for militias?", SCOTUS has settled that question and said it's not. You are aware of that?

I was aware of SCOTUS.

Im not sure when the US made a militia, but I thought it came after the Constitution. Although I wasnt referring to the Michigan definition of a militia, I do know that it came after the US constitution was written. In Michigan, every "able bodied" (man?) over 18-47 iirc, is a member.

I have a T-Shirt I got a few years ago that says "Concealed Carry Works For me." I hardly wear it anymore, since I OC most of the time. I'd like to find one that says "Open Carry Works for me." perhaps with something in smaller type, in parenthesis that says "(And it's legal too.)"

since you OC all the time it the shirt would be funnier now. irony. :dude:

Yep, got one here, right in the middle of "restaurant row". Was a little anxious to see the new one on W. Main.

I wish this forum had "like" buttons. I often times read a comment I really like, but don't want to make many off-topic posts - but I want to hit a "like" button on 'em!

About to go OC at Subway in 2Paws (again)

Im not sure when the US made a militia, but I thought it came after the Constitution.

Again, I think you have some kind of concept of militia which is flawed. The militia of any political group of people (village, tribe, colony, state, nation, etc.) are the individuals who, organized or unorganized, are expected to come armed to the defense of the political group. The militia are these individual people. A militia is a body of these individuals. These individuals may be organized or unorganized, hence you have (even written in law) reference to "organized militia" and "unorganized militia". And "well-regulated", as you know (or should know), does not have anything to do with "regulations", "laws", "organization", etc. "Well-regulated", in the sense used in the 2A and in the time it was written, is synonymous with our modern term "functioning properly". Thus a "well-regulated militia" is a "properly functioning body of individuals expected to be armed and to come to the defense of the [political] group".

All political groups of people, in the real world, have a militia. The American Indians had their militia. The American colonies had their militia. When the colonies formed the US, the militia was still there before that happened and after it happened. The militia in the US exists to this day, and you and I are the militia (if you, like me, would take up arms and defend the country against enemies) along with all other armed individuals who would defend the country, in either organized or unorganized bodies.

Do you get this concept yet?

Hello everybody

I'm new to the forums and pretty new to OC as well. I got my CPL right after i turned 21 and have been CC'ing everywhere i go for the last year, but a few weeks ago decided to go OC. I really enjoy it so far, way more comfortable along with the other benefits such as a quicker draw and crime deterrent. I have been carrying in town Gobles where i live and the Kalamazoo/Osthemo area without any problems at all.

Untill yesterday..
A friend and I went to look at a house for sale on 37th street just north of 108th in Allegan county. We peeked around the house and noticed some two-tracks going back along the property (suppose to be 26 acres) so we jumped in my truck and started to head back, looked like some awesome hunting property.. needles to say while driving through the thick trail my front left tire fell in the edge of a swamp..:banghead: No sooner does this happen a white honda civic pulls up and 3 people get out, one comes up to the truck and asked who we were. Told him i was just interested in the house out front and was looking around. Then he asked me "well why the hell were you running from us? thought you were going to get away? well your stuck now." We apologized a couple times and told them we had no idea they were flagging us down if we had seen them we would have stopped. Not convinced he informs me that I am "trespassing on private property" and the police were going to be called. I pretty much told him ok, fine if it has to be that way and he walked away. My friend and I tried to get my truck out..wasn't happening:cuss: So we figured we might as well sit in the air conditioned truck and wait for LEO's to get there. This guy walks back up to the truck to apparently assure us the police were on the way, and that destruction of property was a felony, following that up by telling us they use the place back there for a SWAMP RUN, with big tractors and ****!! all the time while holding a board with nails at his side (to defend himself against the scary guy with the gun im sure) nothing more was really said though and he walks off. I think probably only 10 minutes went by after that and out of no where we here "GET YOU F@%KING HANDS IN THE AIR RIGHT NOW!" I look up in the mirror and see three LEO's, weapons drawn standing 5 foot off my truck bed.:shocker: So, are hands went in the air, one at a time they had us get out of the truck, walk backwards hands up to the back of the truck while they keep yelling "DONT DO ANYTHING STUPID, NO STUPID ****!!" I get to the back of my truck "Cross your legs and kneel get down on the ground!" immediately followed by a pair of matching bracelets, being dis-armed, and my wallet taken from my pocket all in about 2 seconds.

One took my buddy off to question him, One was talking to me, and their SGT. was talking to the people up front. He asked me what we were doing here and such, I explained i was just house hunting and once they figured out what was really going on everything cooled wayyy down. handcuffs came off, They made me call a tow truck though! "the "property owners" wont allow you to have your brother who lives a block down the road come pull you out because they don't want the property damaged any more" Nothing really was said about the gun until we were waiting around for the tow truck. One of the older LEOs was more of a CC guy and was giving me a little crap about OC, seeing I was in no trouble I gave a little back, not in a rude or smart-ass way just to show I wasn't going to be intimated. The other LEO was a pretty nice guy he told me he loves guns and totally respects my right to carry however i choose and wasn't here by any means to infringe on anyone's 2A rights. As we were chatting one of them told me i probably shouldn't buy any house on that stretch of road because they reefer to it as "meth alley" and also found out that they responded to a MWAG call trespassing on someones property. Which gave me a little clearer view of why perhaps they came in so hostilely, I suppose they were just doing their jobs and they were pretty cool when everything got squared away.. but it was a little intense for a minute. So the truck came and got me out, $40. and we all parted ways. Went to my house to change because i was all muddy, strapped my gun back on and went to a couple stores in town and back home to finish my evening with a couple beers, long day at the office.

However i would like to add that my brother knows the guy who owned the house previously and it was reposed by the bank, so the bank is the one who owns the property. I think these people were just used to being able to use it, with their son owning it before and just still thought it was their property and nobody was coming on it.

And today i met up with Jason (insanebuddy720) at steak&shake on west main, went to MC sports to look for ammo sales, and stopped into On Target to chat and look at some stuff. Stopped at Meijer on the way home for some things, no problems at all today.

And right there is where you earned everything that happened since just because a home/property is for sale doesn't mean it is wide open for folks to just decide to wander all over as they please because it still belongs to someone, even if a bank, and is still private property.

The proper thing to do would be to make an appointment with the seller to be given a tour.... not just drive all over the property as you wish.

I certainly hope you take the time to learn all the laws pertaining to OC because the kind of thinking that just because there is a 2 track means you are entitled to drive your 4x4 down it even if you don't own the property and don't have permission to be on the property will tend to get you in trouble with OC.

Don't need to be a history buff. Every gun rights advocate should have read the Heller vs DC opinion.

Petitioners take a seemingly narrower view of the militia, stating that “[m]ilitias are the state- and congressionally-regulated military forces described in the Militia Clauses.” . . . We believe that petitioners identify the wrong thing, namely, the organized militia. Unlike armies and navies, which Congress is given the power to create (“to raise … Armies”; “to provide … a Navy,”, the militia is assumed by Article I already to be in existence. Congress is given the power to “provide for calling forth the militia,” and the power not to create, but to “organiz[e]” it—and not to organize “a” militia, which is what one would expect if the militia were to be a federal creation, but to organize “the” militia, connoting a body already in existence. This is fully consistent with the ordinary definition of the militia as all able-bodied men. From that pool, Congress has plenary power to organize the units that will make up an effective fighting force. That is what Congress did in the first militia Act, which specified that “each and every free able-bodied white male citizen of the respective states, resident therein, who is or shall be of the age of eighteen years, and under the age of forty-five years (except as is herein after excepted) shall severally and respectively be enrolled in the militia.” To be sure, Congress need not conscript every able-bodied man into the militia, because nothing in Article I suggests that in exercising its power to organize, discipline, and arm the militia, Congress must focus upon the entire body. Although the militia consists of all able-bodied men, the federally organized militia may consist of a subset of them. [Emphases added.]
