You are more correct than I was.Nothing was remanded back to the DC. This is a final ruling. All DC can do is ask for an En Banc panel and if denied ask SCOTUS for CERT as I read the ruling.
I talked to an appellate attorney who practices in DC and he said the DC Circuit rarely grants en banc requests.
