Stopping motor vehicles for driver's license check, vehicle inspection and test — Authorized — Powers additional.

To carry out the purpose of RCW 46.64.060 and 46.64.070, officers of the Washington state patrol are hereby empowered during daylight hours and while using plainly marked state patrol vehicles to require the driver of any motor vehicle being operated on any highway of this state to stop and display his or her driver's license and/or to submit the motor vehicle being driven by such person to an inspection and test to ascertain whether such vehicle complies with the minimum equipment requirements prescribed by chapter 46.37 RCW, as now or hereafter amended. No criminal citation shall be issued for a period of ten days after giving a warning ticket pointing out the defect.

The powers conferred by RCW 46.64.060 and 46.64.070 are in addition to all other powers conferred by law upon such officers, including but not limited to powers conferred upon them as police officers pursuant to RCW 46.20.349 and powers conferred by chapter 46.32 RCW.

you will notice that it uses the all important words and/or meaning they can stop to check your license but they will also be checking to inspect your vehicle to make sure it complies with the minimum requirements to operate on state highways... OR they will ONLY inspect your vehicle.

The major purpose of this law is to do "safety" checks on vehicles. But that doesn't exactly mean that it is constitutional to do random checks.

I read and/or differently. When I see "a and/or b", to me that means that "a" may occur by itself or "b" may occur by itself, or both "a" and "b" may occur together.

Agree. Reads the same way to me.

Not sure what you mean by 'exclusively loaded' but here is the definition of loaded.

RCW 9.41.010 said:
(12) "Loaded" means:
(a) There is a cartridge in the chamber of the firearm;
(b) Cartridges are in a clip that is locked in place in the firearm;
(c) There is a cartridge in the cylinder of the firearm, if the firearm is a revolver;
(d) There is a cartridge in the tube or magazine that is inserted in the action; or
(e) There is a ball in the barrel and the firearm is capped or primed if the firearm is a muzzle loader.

Yep, there are a lot of different systems. In Pierce Co. A majority of the municipalities use South Sound 911 (formerly LESA) for their support systems.

Depending on the system and how they decide to set it up they can have a plate check return CPL info on the registered drivers, as well as also return a list of any handguns an individual has purchased that are entered into the DOL'S handgun registry.

"DOL'S handgun registry" ?? Say what ??

Recordkeeping requirements.

The department of licensing may keep copies or records of applications for concealed pistol licenses provided for in RCW 9.41.070, copies or records of applications for alien firearm licenses, copies or records of applications to purchase pistols provided for in RCW 9.41.090, and copies or records of pistol transfers provided for in RCW 9.41.110. The copies and records shall not be disclosed except as provided in RCW 42.56.240(4).

RCW 42.56.240(4) Regards releasing CPL application info to LE, not releasing "records of applications to purchase or transfer pistol purchases." IMHO.

Are you saying that carrying and possessing a firearm in your vehicle is a privilege and not a right?

Given that it's illegal by statute to carry a loaded one in a vehicle unless you have a permit that you must apply for and that can be taken away...yes, that particular combination of factors is a privilege not a right.

You can believe what you want. LEO's in this state can and do call in a handgun serial number and the DOL will tell them, if they have the record, who purchased it and what ID they used to purchase it. Likewise LEO's in this state can and do call in identity information and the DOL will tell them all the records they have of handguns purchased by that person from a WA FFL by make, model and serial number.

RCW 42.56,240 describes "investigative, law enforcement, and crime victim information is exempt from public inspection and copying under this chapter:"

Records of sales of handguns made by FFLs is not investigative, law enforcement nor crime victim information. In addition, providing the information to a law enforcement agency/officer is not public inspection and copying.

There is no reason for DOL to maintain a record of firearms purchases if it wasn't for the express purpose of providing that info to LEO agencies. You can easily just call the DOL and I am sure they will tell you their capabilities of providing the info to LEO agencies.

They don't even have to call. As I was handcuffed in the back of a Sheriffs vehicle I was looking at their computer screen, and the all the info is there, even long gun purchases.

In addition to being unloaded ,If you do not have a CWP, said firearm needs to be secured out of sight, as in a range bag
or other contained. This information is for Washington residents, requirments may differ in other states.

Your local LEO is wrong. I would have to assume that is the only place that would tell you this false piece of information.

Build your own weapon and bypass all the rigmarole. ARs are exceptionally easy and if you want a home made pistol, I recommend the rudius 1911. No roll marks, no serial numbers, no records.

maybe your dealer filled out a PPA for them and whoever enters the information in the computer at DOL didn't know/care it wasn't a handgun?
Maybe they don't give a rats a$$ about the law and keep a registry anyway.
