A little late perhaps...

I am planning a move out to El Paso County at some point in the next year or 2 and have been concerned about the OC situation in the parks. We will also be making a trip out there this April and would like to carry while we are there (no GA permit at the moment so OC would be only choice.)

Has the Sheriff been made aware that OC is LEGAL in all parks? Sounds like from a previous post there was a conversation with the sheriff and he was under the impression OC is not a lawful activity in ANY parks. It would really suck to be arrested 2000 miles from home.

Signs are down since last year. The Sheriff in El Paso County is the most pro 2A LEO you will ever meet. He is well aware of the law and so are his deputies.

Open carry is legal in parks, according to their ordinances.

I'm no lawyer, but I do recall state law addressing this issue as well, using nearly the same terminology, butaffirming open carry as part of their State defenses.

Re: Para C - that's clearly "brandishing," not open carry. Para D allows brandishing for the pupose of self-defense.

It's same as the state law - why the confusion? Now if some cop hauls you in for open carry in a COS city park, get a great lawyer, use both the COS and CRS statutes, and sue the pants off COS for failing to properly enforce both their own and CO State laws.

It's one of my favorite parks.. I get there every two months or so.

Now I just have to decide between sneaking in cans of beer or carrying the pistol haha :lol:

What I find funny is the term any person. I guess it is unlawful to frighten a criminal into not robbing someone. I can see it now. “What happened, why did you decide not to rob that person? That guy over there had a gun on his hip and it scared me. I thought I may get shot.” Officer goes over to the law biding citizen OC’ing and says: “Sir, your going to have to come with us. You broke the law by frightening that criminal.”

Funny how they state things in laws sometimes. ;)
