FIRST OF ALL!! No you are not required by law to notify you have a weapon in this case, but its common courtesy to do so... If I pull you over and I find out you have a weapon in your car and you never said anything because you think your a harda**, I will be looking to mess up your day... show a positive additude from the start with both you DL and your CWL and I might just cut you loose and let you be on your way.

just a little common courtesy is all I ask for..
I hope you have a good attorney. Your qualified immunity has limitations.

Comments by macho1chris (emphasis on the macho) are different than what I was told by two LEOs and what is legally required in Va, and that is not to tell or discuss your HG with the officer during a routine TRAFFIC stop (which bears no relation to any HG violation).

It's this macho attitude 'I should be the only one with a HG not you ordinary citizens' which cause most of the OC stops, imo.

And, they pull this stuff on people who look like they can be pushed around NOT on people who might be predators or perps. (note the cop and the skateboard kid).

What's surprising is that someone would out their non-legal, threatening and prejudicial attitudes on a message board. It's one thing to do it during a traffic stop where no one can argue, but appears to show low intelligence on a board where people know and can quote relevant law.

What if I don't say anything because it isn't relevant and I didn't think of it? I also didn't mention that I woke up with a boner this morning, but that doesn't mean I think I'm a hardass... It just isn't relevant and we're both better off not even mentioning it.

While I definitely appreciate your position, we're trying really hard to work with mach1chris. Sometimes I wonder if he really is a cop, but his location being Miami, I'd believe just about anything...

I had a Miami cop tell me that CWFLs weren't any good in that pat of Florida...

As a note, even thought my CWFL expired, an FHP showed me that the note still pops up on his computer telling him that I have one... Not that it's relevant to the half dozen guns I usually have in the car with me at any given time... :p

It's none of your business if I have a weapon on me or in my vehicle, I will not be volunteering that info, but if asked I will tell you. It appears you are the one that wants to be the hard*** with an attitude....Lighten up Frances!

Actually if I have my weapon in my car and dont have my cpw it doesnt matter, Law states I dont have to have a license to keep a fire arm in my car.

I wish I did, but it was spoken to me by an Assistant State Attorney. He said it was a case he tried himself and lost. I didn't look it up. Just figured he had no reason to lie about it. I don't remember the guy's name, but he had a stint as an instructor for FDLE. Might still be there; this was over 5 years ago.

Both the Florida and US Supreme Courts have ruled that LEO may not 'Terry" stop a person based solely on the fact that the person posseses a firearm.

This!

It would be nice if we didn't have to teach them the hard way, but it appears that several CLEOs are already training/instructing their staff to defy it.

if you get pulled over and they run your D/L it's going to come up that you have a CCW,then they are going to ask if your carrying.just a good idea to have your permint at all times if your carrying a gun if not you can go to jail & then lose your rights!!!

Partly true. Actually the Photo ID requirement stems from the original enactment of 790.06...the licenses didn't have pics on them and were about the size of a slice of bread.

Don't kid yourself. Once a dispatcher has your DL # or SS# and pretty much your tag, name and/or address it is very easy to pull the fact that you have a CCW permit. I'm not sure if it pops in under any database of the DMV but dispatchers have access to many many databases and some run info searches as a routine on traffic stops very quickly. Plain and simple, don't get caught in a lie on a traffic stop. It will only inflame the situation and make for a bad day. I don't understand how everyone says CCW holders are some of the most responsible law abiding people in the state and then so many CCW holders feel compelled to hate cops. I have no problem informing a cop simply doing his job that I have a concealed weapon. I do not hate cops simply because they are cops. It may not be required by law to inform them but come on "seriously". Maybe it's because I've always shown them the respect they deserve and never really had a bad experience involving police. Things that make you go Hummmm!!!

How so?

Perhaps you could explain to us how the presence of a lawfully possessed firearm is relevant, at all, to the activities surrounding a stop for a traffic infraction?

In my experience this is what 'normally' happens:
1) LEO pulls you over
2) Asks for DL/Reg/Ins
3) Some ask 'Do you know why I stopped you?' and other 'fishing' questions, but I don't play that game.
4) Some ask about guns - I don't play there either - not required by law - not relevant to my burnt out tag light.
5) LEO goes back to his car, does his thing, comes back with a ticket or not.
6) Some want to lecture - I don't play that game either
7) We go our separate ways.

No one is rude or disrespectful, they are doing their job. If I get a ticket for speeding, or whatever, I'm fine with it. I know the rules, I broke them, I'm responsible.

Simple.

Not sure what/why the big deal is about this. Just play it safe,Murphy-proof things as best you can, and have it on your person in case it's needed. No biggie. World wont end if,for whatever reason, an officer asks to see it. It's just yet another thing in the wallet,etc. Unless you're making an issue of it somehow,what's he going to do? Look at it, check it/verify it somehow, then hand it back to you. It's not like he's going to arrest you just for having it...:banghead:

If you're driving, and get pulled over, and you arent carrying your driver's license-8 times out of 10 you're going to be spending the night in a cell. End of story. (unless you luck out and get the one officer too lazy to do his part)Or at the very least, you get a ticket/fine that you have to pay.
