That brings up a question that I've always had -- how exactly and with whom do you request an immediate hearing? If immediate is taken to mean what it sounds like it is, I'm not sure how this would happen as at least here in VA BH as far as I'm aware no court is just sitting around 24/7 in case they need to hold an immediate traffic infraction hearing. And the VB GDC says that they are closed as of 4pm. I've not heard of a magistrate being able to hold that kind of a hearing, but I suppose that's a possibility (although I didn't think that a magistrate is technically a "court")?

I think that is where the immediate or within 24 hours comes into play.

That's where I would have a problem though, as words have meaning. The code doesn't say as soon as possible within 24 hours, or various variations on that theme....it says "immediately or within 24 hours" which sure seems to be not saying specifically what it means. As I (can) read it, both of those are options.

But just to play it out, and still pondering the point....courts close at 4pm on Friday. Assume it means immediate (if possible) or 24 hours (as an outside limit), how then do they comply with the law if court doesn't open until 8am on Monday, or worse, later on Monday holidays, etc.?

This has been on my mind because I have to tell you, if I were an individual who truly believed that they were subject to an invalid arrest (including traffic stops), I'd feel highly motivated to resolve the matter "immediately."
