Chief Chambers received your email on May 10th. I told her there was no reason to respond as it did not appear that you were seeking a response, for that I apologize.

The Henderson Police Department is a nationally accredited professional law enforcement organization. The Henderson Police Department prides itself on the superior level of training it provides its employees in general and in particular its sworn officers. Officers of the Henderson Police Department have been trained and are aware of the law respecting the open carry of firearms in Nevada. Consequently, we fully expect officers of the Henderson Police Department will conduct themselves in a professional manner in all situations they may encounter in the course of their duties.

Henderson city attorney arrested on DUI charges

I assume Nevada cops lie, cheat, and steal when it comes to DUI arrests and charges, and hope she's proved innocent. :)

She voices such concern and fear of someone exercising a constitutional right. Yet thinks nothing of putting people in harms way herself. If she wants to start comparing horror stories like she did about her son, then I would be happy to share mine. The story of how a drunk driver killed my grandparents.

The following is a copy of an email I just sent to the Henderson City Attorney.

Ms. Quillin,

In doing business at City Hall, (Water Department), upon entering the building, I have noticed signage stating that no firearms are allowed in the building. The Statute referenced is NRS 202.3673. This law reads as follows:


(b) A public building that has a metal detector at each public entrance or a sign posted at each public entrance indicating that no firearms are allowed in the building, unless the permittee is not prohibited from carrying a concealed firearm while he or she is on the premises of the public building pursuant to subsection 4.

4. The provisions of paragraph (b) of subsection 3 do not prohibit:

(a) A permittee who is a judge from carrying a concealed firearm in the courthouse or courtroom in which the judge presides or from authorizing a permittee to carry a concealed firearm while in the courtroom of the judge and while traveling to and from the courtroom of the judge.

(b) A permittee who is a prosecuting attorney of an agency or political subdivision of the United States or of this State from carrying a concealed firearm while he or she is on the premises of a public building.

(c) A permittee who is employed in the public building from carrying a concealed firearm while he or she is on the premises of the public building.

(d) A permittee from carrying a concealed firearm while he or she is on the premises of the public building if the permittee has received written permission from the person in control of the public building to carry a concealed firearm while the permittee is on the premises of the public building.

5. A person who violates subsection 2 or 3 is guilty of a misdemeanor.

6. As used in this section:

(a) “Child care facility” has the meaning ascribed to it in paragraph (a) of subsection 5 of NRS 202.265.

(b) “Public building” means any building or office space occupied by:

(1) Any component of the Nevada System of Higher Education and used for any purpose related to the System; or

(2) The Federal Government, the State of Nevada or any county, city, school district or other political subdivision of the State of Nevada and used for any public purpose.

Ê If only part of the building is occupied by an entity described in this subsection, the term means only that portion of the building which is so occupied.

(Added to NRS by 1995, 2725; A 1997, 63; 1999, 2767; 2007, 1914)

As you can see, this law refers to Conceal Carry Permittees only and does in no way apply to those who open carry such as me. I am not aware of any Nevada law restricting the open carry of firearms in such public buildings.

I have also noticed signage in City Parks stating a no firearms policy. This is directly in violation of State preemption. As I’m sure you know NRS 244.364, NRS 268.418 and NRS 269.222 state that the legislature reserves to itself the right to regulate the transfer, sale, purchase, possession, ownership, transportation, registration and licensing of firearms and ammunition. No county, city or town respectively can infringe upon these rights. State law declares all local laws not in compliance to be null and void. A past AG opinion agrees.

I respectfully request that you advise all such departments that they remove this signage and instruct law enforcement that there is no law against such exercise of rights. As a law abiding citizen I wish to go about my business without interference with the comfort of knowing I am able to defend myself and family.

Let us not stoop the the level of our own criminal justice system. She, like we all should be, is entitled to due process. She has not been convicted of anything yet. Our friend Yard Sale was arrested on suspicion of DUI and we would not accept the court of public opinion convicting him before his day in a court of law.

We do not know all the facts. And we must hold ourselves to a higher standard for we would not tolerate prejudice from our officials. For all we know she may not have been drinking but simply dropped her one-hitter which she was using to smoke legally prescribed marijuana and crossed the center line. Presumably, as an attorney, she would know not to answer questions and was arrested and charged pending a full investigation.

Just an aside, her professional photo makes her look far sexier than her mug shot. That, my friends, is Coyote Ugly!

The following is an email I recieved today from the Henderson City Attorney, and my reply...

I wouldn't even argue the point whether an armed citizen will "save the day," or even whether restricting firearms in public buildings is or isn't a good idea: IT IS ILLEGAL. So even if they wouldn't save the day and restrictions were a good idea, it is still illegal for the municipality to impose this restriction.

Ms. Quillin has some issues, I realized that when I was dealing with her. Not that points made here don't have some validity but keep in mind the old verse "let he who is without sin cast the first stone". To bash her in her illness is beneath us. In my opinion the only thing worse than a sore loser is a sore winner. Ultimately she did what we expected of our City Attorney. Let's give her credit for that and move on. The opposition is elitest and we need to see to it that our acctions and arguments are above theirs. Let us look like the reasonable law abiding citizens we are. There is much work left to be done. Let's move on and focus on the task at hand.

Signs

Took the family to Cinnamon Ridge park today on Burkholder near basic High School. They have put tape over the portion of the signs blanking out "No Firearms or Weapons". Checked at Morrell Park, ditto. Happended to be driving by City Hall and decided to check and they still have the same old "No Firearms Allowed" signs posted on the public entrance.

Come to think of it. I haven't heard what her BAC was.:confused::confused:

Just heard on the radio this morning her BAC was .30. Even though she admitted that she was "f#@ked up". Having multiple wine bottles in her car. Wrecking her car. Almost running over someone. Her lawyer entered a plea of not guilty.

We'll at least she's not on paid administrative leave. She's just using her sick/vacation days while she is in a recovery center.

Now my next question. How many sick/vacation days does she have?

So, I just came across this thread for the first time. As I started reading the first post, I had that feeling of impatience that this thing would take forever to work out. Well, as I read on, I realized that it started LAST summer. Woot!

So I just finished reading through it all, and it reads like a great movie. TBG, you have my undying grattitude for sticking with this and getting it done. I am so glad I didn't have to wait, impatiently, to see the final resolution to this.

This is exactly the kind of thing that furthers the whole movement. Baby steps. Well done.

When I first discovered the TV show "24", I quickly realized that I too was impatient to watch it week to week, so instead, I would wait for it to release to DVD, and watch the whole season in a couple of evenings. Very satisfying. Just like this. :)

The one thing that really threw me for a loop is the emotional and unprofessional "mom" responses to a formal inquiry in the course of her professional responsibilities. Forward that to a feminist organization and watch them /facepalm. She just set back their cause a decade. :) I am all for strong, independant women. People like this one just arm the folks that think a woman can't do a "mans job". THIS woman can't. That's all. At least the right thing was done in the end.

I had to get the water turned on in another property we got so I had to go to water st. I OC'd the whole time and was there for about 20 minutes. Utility services is right next to the info desk with two people in it. One was wearing some sort of guard uniform. I was standing strong side to him and I'm pretty sure he saw it. Nothing was said. Thanks to The Big Guy for all your hard work. You sir are appreciated.

I was in there a week or so ago and there was a cop standing out in the lobby, not a word. There was a gal that came out of an office and gave me the once over, I smiled at her and she went on about her business. I have some other plans for going after the county but unfortunately life has been real busy lately with family and work and other issues I'm working on and I just have not had the time to work on them. When you are a trouble maker like me there just doesn't seem to be enough hours in the day.

The signs at Henderson City Hall still were not changed last I looked. I have written the city to ask when it will be done. It has now been over 3 months since I got word that they would acquiesce to the law. I await the response and will share it when I get it.

I have been there several times now with no issues. I speculate that even though they are not enforcing the wording of the current sign, they left it there as a bluff to those who don't know the story.
