Open Carry While Voting

I'll be OCing, my polling place is an Elementary School.

I did the same. No issues. I thought I heard someone behind me tell a poll worker, "excuse me, that man has a gun", but maybe I misheard. Other than a very exaggerated doubletake from a friendly guy behind me- not an issue. I voted, got in my car, drove to work, and on my way, my eyes watered up a little bit coming to realization how much liberty I have in this country to be able to carry a gun to a polling location in an elementary school and vote for candidates that will fight for my right to keep doing that. We have a long road ahead, but to just stop and see how far we've come in just a few short years, it's amazing. I love liberty!

Was in and out in 15 minutes. A couple wide eyed looks but nothing said.

Glad it went off with a hitch. My holster is rocking my voting sticker ;)

I voted this morning around 7:45 at the Davison VFW on Lapeer rd. lots of people there. There were 2 ladies directing people to the proper precinct and my pistol was noticed as soon as I got in the door. NOTHING was said. I proceeded into the polling area and got my ballot, about 10 minutes in line, went to a booth and proceeded to spoil my ballot. :banghead: Never in nearly 40 years of voting have I spoiled my ballot. I guess theres a first time for everything. I went back to the table to get a new one, joked a bit with the ladies... at my expense of course, and finally got to the booth again to finish up business. I was in there for 45 minutes so there was plenty of time for someone to complain or call the POPO:shocker: A good experience in all. Not one word was said to me by anyone there about my carrying. Oh yes, the recorder was on too.

ok, but if you are openly carrying a firearm in a PFZ you are breaking the law, unless you have a CPL, correct? so when asked to show it, and you don't, wouldn't you be arrested for carrying in a PFZ?

i'm not one to just offer up my id, but if i was OC in a PFZ i think the best option is to show id if requested by a LEO

I believe it's still yet to really be determined in a courtroom. I can see how one would assume because you are carrying under the power of your CPL you would need to show it. But like mentioned above driving a car on the road is illegal unless you have a drivers license. And so is carrying a pistol on your hip if you're a felon, the pistol is unregistered, or your're under 18. Which we know doesn't give LE the ok to ID you just to check. Personally, I was OC in a PFZ with 6 police for over 45 minutes refusing to ID and was never arressted. Maybe I was just lucky, and perhaps I should of ID'd to save myself the drama, but if I was doing anything illegal it seems as though I would have been arressted in the near hour the whole thing took. rather then trasspassed for "creating a disturbence"

OT
I voted at town hall this morning and was ballot 92.. and, 103..:banghead: all went well no lines in gobles and nobody said a word or any goofy looks about my OC pistol; however Bloomingdale has had an hour or two wait all day.

OC'd at Gretchko Elementary School to vote this afternoon. No issues at all. A lot of people there, I'm sure it was noticed. On the way out, a campaign volunteer asked what range I normally go to in the area. I told him "Pontiac Lake" and he said that's the one he goes to as well. :)

OCed at Catholic Social Services building this evening in Detroit, ballot number 550. I receieved a few gawks from some of the older men but no one uttered an audible word. I was dual carrying the twins on my left and right side; no problems, no issues.

If you are driving you must have a drivers license too. But simply driving does not give a LEO the right to stop you.

But this is because a SCOTUS opinion decided this in Delaware v Prouse (1979). Please show me a case where appearing to violate the law by OCing in an area that requires a person have a CPL has been deemed to require an officer to have a higher level of suspicion than mere possession.

If one could argue that RAS is questionable, I still think it's dangerous to say in absolute terms that a person need not show ID.

He usually wears his vest when biking. This makes perfect sense as both his hands are tied up steering the bike. If you have ever cycled in the city, you know that often the crappy roads force you onto the sidewalk and within arms reach of pedestrians. I forgot the Q is an urban combat master, so he has no need for a gun most of the time let alone a vest...(just razzing you Qball). :p

I oc'd my 1911 to the city owned Nampa Civic Center in Nampa, Id. It has "No Weapons" signs at the entry ways. I anticipated some issues. Was pleasantly surprised no problems!

Hope you don't mind an Idahoan chiming in.

I want some grips like those, Curm!!!

There is no case law on this particular scenario.

It is unlawful to possess a pistol anywhere in the state without a license to purchase. Msp indicates in their legal update that their officers are not allowed to stop an individual simply to verify that the individual has a valid license to purchase.

One can extrapolate that since they cannot stop you simply to verify that you possess the proper license in one scenario they likely cannot stop you in an almost identical scenario to check your license.

We also know it is unlawful to operate a motor vehicle on the highways of this state without a proper license, yet it remains unlawful to stop a vehicle just to verify the drivers license n

But I can emphatically state that by doing something which requires a license one is generally required to show the license to a LEO, save one activity: driving an automobile. This exception is there only because of the aforementioned case.

I am all for the argument that they shouldn't be able to check your license, BUT to assert they can't stop you to check as if it has been decided by some court only puts people who follow the advice into a potentially costly situation. I think it would be better to present the issue in the most cautious way in a public forum.
