All,

My trial is still scheduled for Jan 20th. We've just completed the depositions of the primary responding officers, Capt, and Sherrif of Lincoln County. Pretty incredible (in a bad way) stuff in there and I'll release more as my lawyer authorizes it.

I travel to Cheyenne this weekend for my deposition with their attorneys.

And the fact the OP is a vet has no bearing on this -- its just color for the story.

The news paper articles you provided already shows the dis-honest statements of the LEO's. They state that they detained you "because you refused to let them know if you had a gun or not"...... I have heard from your recording, from their mouth as well as your own words that you NEVER said that. You only refused a general search. If I know that sitting all the way over here in Owingsville, Kentucky (don't feel bad, not many people have a clue where that is either) they should know that too. I wish you the best of luck and hope you f**k them up. By the way, even if you had a "concealed permit" (the names of these permits vary state to state) with your gun concealed and you refused a search based on their lack of RAS or PC, the 4th protects you from illegal search and seizure!!!! You know that. I know that. It's a damn shame that they don't know/care about that.... From one "we the people" kinda man to another, thank you for standing up for our rights.



On a side note. The day I listened to your recording of this illegal detainment, I went out that day and bought my own recorder. I believe that act of you recording this incident will make your case a slam dunk..

So... If it was openly carried why would the cop need to be told about the gun? Didn't he see it, which is what started all this in the first place? Am I missing something?

A lot of guys on here preach the ole 42USC1983 suit.... So I have to ask, are you filing a 42USC1983 suit in your case? I only ask because even though it is mentioned on OCDO a lot, due to the lack of success of the 1983 suit, I have little to no faith in it as far as the 2A is concerned.
