I always inform just because there was usually a good reason for stopping me so i prefer to talk guns instead of speeding. Anyway, last fall, i was late to a ride and was stopped riding a wee bit fast. I forgot to tell him about my permit. Anyway, when he comes back i went to tell him and he cut me off mid sentence "first off, you arent required to inform under TN law, secondly, i assume everyone has a gun. if you don't, you're a dumb@ss and deserve to get shot" (we're in memphis so that may help some of you understand his rational). Anyway, it was pretty funny.

back to the current case though. If he has a permit and the gun was not cased, it doesnt sound like any laws were broken. Having a gun in your car isnt OCing (at least in my mind but Im not an LEO).

No. And he didn't give me a ticket anyway. It's funny it was a WV Trooper and when I told my neighbor and very good friend who has been a WV Trooper for a long long time he seemed very concerned and even irritated about the ordeal. I assumed he was harassing me because it came up on his PC that I was a CHP holder, but my buddy doesn't think it comes up. Or it didn't back when he was ticket-cop. He's been in the undercover drug side of it for years though.

I thought Florida had a court case that showed this means only when lawful to do so. Like surrendering ID papers.?

From the information I had seen about what happened, I don't see what law he violated. The article I read said he had a permit I take that to mean a CWFL. So he can have it anywhere in the vehicle. And having it under the seat is not open carrying. I would guess the charges will be dropped if the report are accurate.

Sucks to be him. Can be the rap (hopefully) but cant beat the ride.

There is no law that requires you to inform LEO'S that you are carrying. However the LEO'S will tell you that you do have to inform and some will give you a very hard time if you don't. You do have to tell them if they ask if you have any weapons on you or in your vehicle.

You do not need a Concealed license to carry in your vehicle as long as it is securely in cased and not readily accessible.

Securely in cased is in a retention holster, glove box, or anything you have to open or unlock, velcro strap or button to push.

Can you not invoke your 5th Amendment rights? Or are those rights rescinded in such cases?

I've had this situation happen to me. Pulled over for tag expiration (not 100% sure but my belief and agreed with by the DMV drones that my little sticker indicating the year the tag expires was stolen).
Anyway it went like this:

Cop: Your tag is expired.
Me: Here's my registration it clearly is not expired.
Cop: You must have forgotten to put the little sticker on your tag. Do you have any weapons in your vehicle?
Me: What?
Cop: Do you have any guns or other weapons?
Me: Why are you asking me about guns?
Cop: For both of our safeties.
Me: I'm not answering your question.
Cop: Ok so that means you do have a gun. (he literally said exactly this)
Me: What's the point of asking? If I was a criminal I would just lie about it.
Cop: We are trained to tell if you are lying or not.
Me: I'm not answering.
Cop: Look just answer my question and I won't write you a ticket and you can be on your way.

Perfect time to inform him he's being audio recorded and a copy sent to the Sheriff.

We will have won when technology reaches the point where the cop gets a call on his smart phone while walking to your car and sees himself on his phone walking up to the car, taken by your camera.

Perhaps along with the words, "Streaming to you live from all over the world!" plastered across the top.

You must remember, the Supreme Court has ruled that cops don't have to know the laws they are attempting to enforce. as long as they "think" they know the law (even a law that doesn't exist) any arrests are good.

Sorry, you're mistaken. Why promote a lie here? You do NOT have to answer such questions about 'having weapons'.

You have to disclose you have a permit upon demand during a legal stop.

NFL Media Insider Ian Rapoport reported that the 29-year-old was pulled over for rolling through a stop sign, per a source close to the player. The police officer asked to search his car. Johnson cooperated, as he had nothing to hide. The police found his licensed and registered firearm under a book bag under his seat instead of locked up in the car.

Total BS.. Sounds like he stupidly consented to a search and helped the cops fill their quota. Will the gun groups help support him in this case?
