And what if Newsom gets his BP so high over this that he has a stroke and solves so many CA residents problems by being removed from office as "medically unfit"? 😈 :ROFLMAO:(y)

Judge Benitez has issued other well thought out and written pro 2nd amendment rulings.

They all have been shot down on appeal in the 9th circuit.

I believe his rulings are written for the supreme court.

Time well tell if any of them make it there.

Considering what those LWWs (BLM, antifa, Pelosi, et al) wish upon us, that sounds more like a "do unto others" attitude.

I thought he did a really fine job of shredding the traditional arguments against AR15s. He really did pick apart their statistical rationale. But, then he said this (on page 47): "More people have died from the Covid-19 vaccine than mass shootings in California.". Without citation, which has already been disputed. His comparison of the AR15 to a Swiss Army knife has been ridiculed by the gun control crowd. No surprise there.

Let's hope that these issues are truly minor and that he's not letting his pen outrun his thought process. I certainly hope they don't hurt the chances that this will be SCOTUS case.

Quote from opinion, page 47.

The statement is true. Per the CDC, to date, over 5,500 people have died from the COVID-19 Emergency Use vaccine.

The judge's point is when liers figure, figures lie.

As anticipated...

California AG appeals judge's ruling overturning decades-old assault weapons ban

California's top prosecutor on Thursday appealed a federal judge's ruling that struck down the state's decades-old assault weapons ban as "unconstitutional," harshly criticizing the court's opinion and its arguments.

"I think we can agree that the decision was disappointing, and the reasoning, such as equating assault weapons to Swiss Army knives and false claims that Covid-19 vaccines have killed more people than mass shootings, was shocking," state Attorney General Rob Bonta said at a news conference at the Zuckerman San Francisco General Hospital and Trauma Center, a facility known for treating gunshot victims.

Bonta, who was joined by Gov. Gavin Newsom and other Democratic officials, gun control advocates and a trauma surgeon, added that "in many ways, the opinion was disturbing and troubling and of great concern."

Highly unlikely.

From https://www.cdc.gov/coronavirus/2019-ncov/vaccines/safety/adverse-events.html

Over 285 million doses of COVID-19 vaccines were administered in the United States from December 14, 2020, through May 24, 2021. During this time, VAERS received 4,863 reports of death (0.0017%) among people who received a COVID-19 vaccine. CDC and FDA physicians review each case report of death as soon as notified and CDC requests medical records to further assess reports. A review of available clinical information, including death certificates, autopsy, and medical records has not established a causal link to COVID-19 vaccines. However, recent reports indicate a plausible causal relationship between the J&J/Janssen COVID-19 Vaccine and a rare and serious adverse event—blood clots with low platelets—which has caused deaths. Get the latest safety information on the J&J/Janssen vaccine. CDC and FDA will continue to investigate reports of adverse events, including deaths, reported to VAERS. (emphasis by source).

Alas,
(CNN)The US 9th Circuit Court of Appeals has blocked a federal judge's controversial ruling that overturned California's longtime ban on assault weapons, in which he likened the AR-15 to a Swiss Army knife.
In an order Monday, a three-judge panel on the federal appeals court issued a stay of US District Judge Roger Benitez's order earlier this month that overturned California's three-decade old assault weapons ban.
The state's current assault weapons laws will remain in effect while further proceedings continue, California Attorney General Rob Bonta said in a statement on Twitter.

California's constitution does not address the bearing of arms. Even so, the federal constitution applies to California, specifically the second amendment.
United States v. Cruikshank, 92 U.S. 542, 553, 23 L.Ed 588 (1876):
The rights of life and personal liberty are natural rights of man. “To secure these rights,” says the Declaration of Independence, “governments are instituted among men, deriving their just powers from the consent of the governed.” The very highest duty of the States, when they entered into the Union under the Constitution, was to protect all persons within their boundaries in the enjoyment of these “unalienable rights with which they were endowed by their Creator.”
I think you know where I'm going with this.

The fact that the very liberal 9th would block the judges order was a "given". But, in doing so, they may have set this up to go all the way up and get a "national ruling".
This could get interesting. :devilish:
