I was in the IHOP in Oshkosh today and over heard a partial conversation about weapons. I asked the manager about it and she said we don't what guns here. Ok why aren't you posted? It might hurt our business if we do that she says. She also said the would ask anyone they see to leave. I told her I would not be back, she should post the place, and that I would be sure to put her place IHOP OshKosh on the net as anti-gun. It appears IHOP Corp policy is gun friendly though.

Never recommend a place to post. If you are asked to leave, then do so, and then complain to corporate on how you were treated.

My thought on telling the manager to post was I did not want someone to go in there and then have the cops called because the store did not have a sign up. I hate seeing a business trying to have it both ways like Target.

I am sorry if this has come up, I browsed the thread, site, and Google have not given in a good straight answer.

If I conceal into a store (say Toys R Us) that has a no weapons sign and someone notices (for whatever reason). Is that a CRIMINAL offense? I they call the cops can one be arrested and actually charged with something? I was reading the WI DoJ post about CCL but nothing is really said on there.

A follow-up, the sign has to be 5x7, if it is not is that sign then null and void?

Technically a civil forfeiture. They do not need to warn your or ask you to leave. If they do ask you to leave and you don't then it can become criminal trespass, which has stiffer penalties.

If they aren't 'legally' posted, you can fight it but you still might get the ticket.

I had also emailed a CCW instructor and he claims that "There is no specific charge related to those signs". They can ask you to leave and if you refuse it's trespassing.

esullivan, i quick couple of rhetorical questions are in order for you to ponder...

why would you enter some place YOU have been shown, by signage, they do not wish you to enter?

why would YOU wish to endure the angry confrontation with those kind souls of the property telling you to leave or if the property folks decide they don’t wish the confrontation go immediately to the phone so the nice LE who respond can discuss your situation?

why would YOU bet you life that the phone call(s) to the nice LE were’t made by an anti who tell the dispatch you are waving the big bad firearm around in a threatening manner, or there has already been firearm discharge cuz they know they heard a couple of booms!!

(wait, are there multiple sirens i hear in the distance; now large numbers of running foot stomps; wait i can’t understand you- everyone is screaming at me at the same time; oh i get it, you want to see my holstered gun, let me show you its holstered.....kapow numerous times!!

While you didn’t get hit in the barrage, but a friend or loved one who was with you did!) far fetched, no!

so surely esullivan, these risks and judicial conflict are not worth you ignoring a 5x7 sign?

Cork & Bottle Liquor Store in Janesville has removed their no firearms sign. I talked with him a few weeks ago, and he agreed the sign didn't make sense.
