I'm not sure of your question, but Part B is refering to Part A, the definition of assault firearm.

taurusfan "B" refers to definition outlined in paragraphs # 1 & 2 above which states the definition of 'assault weapon' with mag in excess of 10 rounds!

citizens in possession of an assault weapons with mags greater than 10 rounds is punishable by blah blah blah!

"SB 16, introduced by Sen. Richard L. Saslaw, would create a total ban on commonly-owned semi-automatic firearms, like the AR-15. Even worse, the ban would even extend to common firearm parts. The restrictions included in the proposed legislation does not grandfather current owners. The legislation is clearly designed to be firearms confiscation, as current owners would be forced to dispossess themselves of their property or face a felony conviction."

Northam is proposing no new sales and registration for current owners:


"Virginia Governor Ralph Northam is backing a proposed ban on “assault weapons” that would prohibit the sale of many semi-automatic firearm designs like the AR-15, but would grandfather existing owners of the weapons so long as they are registered — or else face surrender"

During this time period, such person shall (i) render the assault firearm, large-capacity firearm magazine, silencer, or trigger activator permanently inoperable; (ii) remove the assault firearm, large-capacity firearm magazine, silencer, or trigger activator from the Commonwealth; (iii) transfer the assault firearm, large-capacity firearm magazine, silencer, or trigger activator to a person outside the Commonwealth who is not prohibited from possessing the assault firearm, large-capacity firearm magazine, silencer, or trigger activator; or (iv) surrender the assault firearm, large-capacity firearm magazine, silencer, or trigger activator to a state or local law-enforcement agency. A person who legally owns an assault firearm on July 1, 2020, may retain possession of such assault firearm after January 1, 2021, if such person has obtained a permit to possess an assault firearm from the Department of State Police in accordance with subsection § 18.2-308.13. The provisions of § 15.2- 915.5 shall not apply to any assault firearm, large-capacity firearm magazine, silencer, or trigger device surrendered to a local law-enforcement agency pursuant to this section.

All they (cops) have to say is their oath of office prevents them from enforcing any statute that is in conflict with the law of the land including the Virginia constitution. Further, since both those documents were written in such simple form that the ordinary common man can understand, judicial interpretation would be inconsequential. And further, since officers poses discretion, any mandate to enforce unconstitutional statutes would be deemed an illegal act.

The last thing we need to do is promote a armed revolt. We need to let the left keep using a backhoe digging their own grave. We also need to keep a eye on the rest of the bills that are introduced. Northam is sitting on a powder keg at this point.

Well, the House of Delegates committee this morning sent HB 961 on ahead by a vote of 12 to 9.

The following changes were made:

1) owner's of 'assault weapons' don't have to register them with the State Police
2) maximum magazine capacity increased to 12 rounds
3) no more open carrying of a rifle if you have a concealed carry permit in certain larger cities like Richmond.

After January 2021 you have to dispose of your magazines over 12 rounds or you're a class 6 felon.

What else?

Will this new law also apply to the "Mentally challenged and the Criminals?

If it didnt work in Chitago....what make them think its going to work in VA?
