Here is the letter i am sending via USPS to all 3 county commissioners regarding signage entering this park. Kinda upset cause this is a fav hunting ground for whitetail deer.

Thanks, I sent the letter snail mail to all 3 commissioners and gave them 5 business days to respond. It was postmarked 8/2/11 so they should have it today and should have a response letter by monday or tuesday.

Well it's been enough time so i sent an email to a attorney on what he thinks my next course of action should be......of course this is a free consult type thing lol.....being how the economy has not left me out of the party.

"Hello, just a couple questions. I liked your facebook page and figured i would seek your view. I have pasted a link to my picture i have posted on my facebook page of a scan of a letter i sent to the Madison County Commissioners, all 3 of them. I still as of this date have not recieved a response. My Question is should i, send another letter.... send a letter to the Attorney Gen. or seek local legal council? "

This is the only thing I could find in the State Statutes regarding the regulation OCing of firearms other than 18-3302J.
(that has something to do with "Parks")

In looking up the park, it seems to be a county owned park. In that case 18-3302J (2)&(3) imo apply.

(14) Have the authority to regulate firearm discharges in state parks for the protection of the public.
However, this subsection (14) shall not apply to or affect a person discharging a firearm in the lawful defense of person, persons or property or to a person discharging a firearm in the course of lawful hunting. The possession or carrying of firearms is otherwise regulated by chapter 33, title 18, Idaho Code.

There have been some changes in "standing" because of recent firearms cases, I believe in IL and NJ.

Look at that SAF suit in Chicago that is going on now. None of the plaintiffs have actually been charged, but they have proved "standing" (the law potentially damages them)

It would be my understanding that you would need to be a citizen of that county, and a user of that park, in which case you could claim standing because of "potential" injury (this being arrested). Now this stuff is brand new (last year or less) so an attorney would have to read the rulings carefully to see if you would qualify. This is one way to present a suit without exposing yourself to potential criminal charges.

I think the best thing to do is: #1: Physically, and Personally contact the commissioners at one of their regularly schualed meetings...They usually have an "open comment" period. Be ready, be clear and concise, you will probably get 3 to 5 minutes to present your case. Then it will go to "consultation" (county prosecuter), then it may make the agenda for formal comment and finally something done. You may be able to talk to the commissioner that represents your area before hand too.

Of course: the optional method is, take you firearm into the park and see if they try enforce their rule. If they do, you automatically have standing, but then it will not be on your time schedual.

Update 11/8/11

Well during recent hunting trips back to the area, i took time to take a detour and check out the signs. And what do you know...... they changed it.

They didn't remove the "No Weapons" part, but instead placed a sticker right after saying "Discharged in the Campground".

So now the sign states " No Weapons Discharged in the Campground"

A small win, But still a WIN!!!!!!

Thanks for the offer but having a Day job 5 days a week makes it hard to just take the 4 hour skip to boise. One of these weekend's the GF and I will make a trip over to Wild bills.
