You are correct. I was frustrated hearing one of the legislatures argue that you could always open carry. That is not exactly true. You can only open carry in towns where they don't prohibit it. That is UNLESS you have a CCW permit (this part is only a few years old). Prior to that change in law the townships had the right to ban open carry. So unless you have a CCW permit I would recommend doing your research before open carrying into different municipalities (i.e., St. Louis City).

I'm confused. So is it law immediately? Or must it be finalized by the MO house and then it's law in 2017 as I originally thought?

The bill has become law, but does not become effective until 1/1/17.

I think its a win for people to be able to concealed carry without a permit! Plus the other gains in this bill! Being able to carry openly everywhere in the state at lest we can still work toward it. Better to gain some ground than loose any.

Thanks to all those who worked hard toward this! Im sure there are many on here that have worked behind the scenes!

You can open carry NOW in towns in Missouri that have banned open carry....but you have to have a CCW permit to overide their open carry ban.......Didn't see post 63 before I posted...

That depends on who is doing the counting. Most would say Missouri is number 11; but there are actually a total of 12 states that allow some form of unlicensed concealed carry of a firearm in public.

Full unrestricted Constitutional Carry: Vermont

Constitutional Carry age 21+ (persons age 18-20 must open carry or have a recognized permit): Alaska, Arizona, Kansas, Maine, West Virginia

Constitutional Carry age 21+ and a resident of the state (persons age 18-20 and nonresidents must open carry or have a recognized permit): Wyoming, Idaho

Constitutional Carry outside city limits: Montana (this one is usually excluded from lists of constitutional carry states since a permit is required for concealed carry in city limits)

Constitutional Carry age 19+ beginning 01/01/2017: Missouri

Constitutional Carry if the gun is in an external carrying case (like a purse) or contained in a holster: Mississippi (carrying a concealed handgun loose in a pocket or in the belt area without a holster still requires a permit)

Constitutional Carry disputed: Arkansas (Prior to 2013, the relevant portion of Arkansas law said that carrying a handgun "with a purpose to employ it against another" was a crime; and mere possession was generally construed as having such a purpose. Act 746, passed in 2013, changed the criminal code to say "with a purpose to attempt to unlawfully employ it against another" and therefore now requires the prosecutor to prove intent to commit a separate criminal offense when carrying a firearm. However, the attorney general has issued an opinion saying that, while Act 746 did legalize open carry with no permit, it did not do so for concealed carry. Some local prosecutors have threatened to prosecute people who carry concealed without a permit; and it will likely take a court case to settle the issue.)

KCgunfan is correct since state low is now pre-emptive and overrides city/county laws that are more restrictive.

so since state law allows CC without permit, the city CANNOT enforce a permit requirement for such, as such law would be more restrictive/harsh than state law.
