If you want to carry in the Memorial Day Parade, contact your CHIEF OF POLICE.

He can issue you a letter giving you permission to carry in the parade. Make the request in writing!

Something like:

As you are undoubtedly aware, Wisconsin Stat. § 948.605 makes knowingly possessing of any firearm within a school zone a felony unless the firearm is unloaded and encased. As you are also aware, the veterans color guard will be participating in the Memorial Day Parade this year and state law requires you to give them permission to carry a firearm within a school zone or they are subject to a felony arrest. I am requesting the same permission you have already given the veterans so I too can participate in the upcoming Memorial Day Parade and carry a firearm.

Please let me know your decision as time is of the essence.

That is what I would deliver in writing and in person.

If they don't give permission to anyone, then the vets are subject to a felony arrest. If they give the vets permission, but not you, then WCI should file a discrimination suit against the city ASAP.

Do the Vets carry working rifles or are these rifles "demilled" so they cannot fire? Just curious. I know Wisconsin law is convoluted and if a "real" gun has been changed into a non-gun then one can be charged with a "facsimile" weapon.

You're right Doug, state laws requires that they GET permission, not that anyone GIVE permission.

Carrying facsimile firearms is not illegal.

Carrying one "in a manner that could reasonably be expected to alarm, intimidate,
threaten or terrify another person
" is illegal.

Vets with rifles in a parade would not reasonably be expected to alarm anyone.


Edit: Whether those rifles can fire live ammo, I don't know. Good question. I'll see if I can find out. They're capable of shooting blanks, as they do for salutes at military funerals and other ceremonies.

I went back and read the statute, thank you Doug! NO PERMISSION REQUIREMENT EXISTS if the Parade is "approved" by the school.

So if the Parade is an approved program, any parade participant can carry.

If the Parade isn't approved by the school, then only LEO and "licensed" individuals may carry.

The United States Rifle, Caliber .30, M1 (M1 Garand) rifles carried by the vets of the VFW and American Legion generally have blank firing adaptors welded into the barrels. At least that is how the M1 that I have used for 21 gun solutes has been. And we never cleaned them either so firing a live round through one would probably be more dangerousfor the guy pulling the trigger than the person on the other end.

I do think you are correct. I have seen a few of the AM. Legion M1s, and all had a welded adaptor installed. I would guess at one time live rounds were used, but I can only guess what happened to change this.

Then that answers that! The rifle is still a rifle but has a welded blank firing adapter on it so firing a live round would be very, very bad to the person firing the rifle and anyone around him. Not a facsimile either.

That's my understanding as well, it is STILL a firearm.

So once it is uncased (loaded or not) and carried into a school zone, the individual carrying it may very well be subject to a felony arrest.

I'll agree with some of 2nd's statement, check with local LEO and DOCUMENT everything.

Good point, because legally the "firearm" is the receiver-- the part the ATF considers to be a gun, and not the barrel. You can buy all the barrels you want without any paperwork.

I know that I cannot have shipped to me in Wisconsin any "gun" made from a parts kit. Last year I attempted to purchase a VZ-58 completely assembled with a fake receiver. No go. Same for a 1903 Springfield rifle that had been demilled by plugging the barrel, cutting and welding the firing pin and welding the bolt shut.

Was it because of a law or because of company policy? Sometimes companies have strange interpretations of the law and will not ship things to WI that they legally could, e.g., pepper spray.

They interpreted their products to be "replicas" which are illegal in Wisconsin. Check out the IMA-USA link. They list states they cannot ship to due to state law....we are one of them. :X
