Is there any more information on not being able to carry in an establishment licensed under the Michigan liquor control act? Does this include party stores that sell only beer (say for example a gas station)? Does it also include any resturants that serve alcohol, like Applebees, Chillis or the like? I plan to start carrying this weekend when I get back from my vacation and I just want to make sure I have everything right.

Thanks

From my experience i would suggest reading the open carry info thread again. From my understanding after reading the info thread for the 502nd time... To answer your first question, may carry your firearm in any establishment that sells alcohol so long as the alcohol is sold without the intent of being consumed at that establishment (ie; in a sealed bottle, container or case). For your second question i guess this has alot to do with the restaurant itself. Im not to sure of the percentage but if the restaurant sells more alcohol than food... then its a no go. but if the restaurant sells more food than alcohol then ur golden... so long as ur not drinking and you do not touch an open glass of alcohol. This is my understanding of the law from what i have read here and researched on the michigan legislature website. so if i am wrong please correct me.

OCed at Old Chicago in Meridian Township this afternoon. No problem, but it got me thinking. If you don't have a CPL you can't carry there because of the booze and if a person has a CPL and OCs he must have it on him and present it when asked by a LEO. So much for going sterile in a place that sells alcohol.
Is that a restaurant, or a bar? If it makes less than 50% of it's income from the sale of alcohol, then CC with a CPL is safe. It's only if it's primarily a bar, i.e. makes more than 50% of total store income from the sale of alcohol for consumption on the premises.

It qualifies as a restaurant. With a CPL I can carry OC or CC there but I must have my CPL with me even though I OC since a person without a CPL can't OC in any place that serves alcohol. So it would be reasonable for a LEO to ask for ID and a CPL if I was OCing in a place that served alcohol. That's all I was trying to say.

What got me thinking was I often don't carry ID or my CPL when I OC, but had to think Oh man I need it if I OC in a place that serves alcohol. It was just a heads up but since most of you guys are on top of things perhaps I just wasted your time.

Too many damn laws to worry about.
No, I'd say you made a good point. At least for those who might not carry their ID with them all the time.
Yeah, That

So I got two different answers... I do not have a cpl. It will probably never be an issue since I don't dine out very often, but I don't want to be out and about and decide to eat at a restaurant but have to keep my gun in the car.

It's kind of funny, I've told my friends, wife and family that I intend to start carrying and everyone just says "why?!" and they don't understand why I would want to. They also think that it's completely illegal, and when I inform them that it is not, they say "well yeah, it probably wasn't 100 years ago, but it's not acceptable today, just try it but I'm not bailing you out of jail" me->"but why would I be arrested?" "because, I'm sure they could arrest you for public disturbance" me->"as far as I know the attorney general has said that disturbing the peace and brandishing are not legitimate charges for carrying openly". So I've been challenged and confronted before I've even carried openly. If I can make it in my house, I should be able to go anywhere in town!

I think the foregoing is a pretty good summary for a beginner. The law regarding open carry of a firearm in an establishment where alcohol is consumed is very complicated and tricky to understand.

No, not yet. I plan to get one, but I can't afford the class at the moment so I'm waiting until 2008 tax returns (a great time to buy a new gun too)

I've been trying to read and learn as much as I can, but it does seem like some topics of the law are very vague. And since they're vague, it leaves a lot for interpretation, especially by a LEO.

I'm sure there will be, this is still a pretty small town with a low crime rate. If they get a mwg call, they'll be all over it.

If you do not have a CPL you can not carry in a place the SERVES alcohol by the glass. You can carry in a store that sells alcohols to be consumed elsewhere.

If you have a CPL you can carry CC or OC in a place the serves alcohol if the sales of booze is less than the food. But you can OC with a CPL in a Bar that doesn't sell food, but it's private property and they can ask you to leave.

Great, thank you for the clarification on that.
