Open carry in Albuquerque and Santa Fe

After reading several of the pastthreads regarding OC in some of NM,slarger cities, I wanted to comment on my experiences. The wife and Ilove NM and we travel thereregularly, especially in the spring and summer months. While we travel to all parts, we especially like Albuquerque and Santa Fe and usually visit at least one of these places on each trip, regardless of where else we go. While I prefer to carry concealed (we both have permits), I am very hot natured and as you know summer in NM is not exactly cool, thus, Iusually end up carrying openly.

In all the times I have carried openly in NM, never have I had the slightest problem. On numerous occasions, I have spoken to police officers on the street, such as in old town, and never aproblem. The only time my sidearm was even addressed was by an Albuquerque officer who politely mentioned to be careful which shops I went into in that area because severalsold alcohol and as such were off limits for carrying and that was only after I initiated a friendly conversation with her first.

The same is true of Santa Fe. I have engaged in conversation with officers on several occasions while in the market area with the only mention of my sidearmbeing in admiration and to discuss preferences and attributes. To date, I have never been harassed or even questioned while OCing in NM.

Regardless of any personal feelings they may have to the contrary about me openly carrying my sidearm, the officers in Albuquerque and Santa Fe (as well as every other NM town I have OCed in) have been nothing but friendly, courteous and professional toward me. While I am sure there have been negative encounters with officers, it certainly has not been my experience and I feel any such incidences were not a reflection of the attitude of the department or the officers as a whole.

I for one appreciate the people of NM allowing me and my family to provide for our protection when visiting your state. With the recent change in the law concerning stores that sell alcohol, you havegreatly improved your already excellent firearm laws. (Now if you can do something about restaurant carry where alcohol is served you will pretty much have itall covered). :D

Thanks New Mexico

That's good to hear.

I don't get to NMasmuch as I should...since I live pretty close to it I should go more often.

I asked this before but I don't recall anyone responding...do theVillage Inn restaurants (VI) in NM, at least Albuquerque where you have been (don't know if there are any VIs in Santa Fe),allow OC there or are they posted? I know that they don't serve alcohol but their policy might be to not allow OC in their restaurants.

Have you been to the County Line restaurant (at the far north end of Tramway Blvd.)? Do you know their policy?

I have not been to the Village Inn Restaurant, so I can not help you there, however, I have been to the County Line a couple of time and I am almost certain they have a bar, thus,it would be off limits for carry.

Since virtually every restaurant in MN serves alcohol, I just automatically disarm when I enter a restaurant. So far I have not found one that does not serve alcohol, except for thefast food joints. I will have to keep the Village Inn in mind the next time we are in Albuquerque, if as you say they are alcohol free and allow carry. Not that I have anything against drinking, I just never drink when out on the town, thus, alcohol establishments in NM cramp my carry ability, which I do anytime I go out.

Thanks for your reply...I forgot about the bar at the County Line!

As for Village Inn, hopefully they are like IHOP and "go with whatever the state law is re: firearms laws," if I recall correctly someone here posting that a while ago (someone who had an OCmisadventure in one of them), so IHOP may be okay. I go to Dennys sometimes, too.TMK, none of these coffeeshop-type restaurants serve alcohol, but I don't recall if any are posted.

Yes, that alcohol limitation -- at least re: family restaurants vs. bars -- is really stupid and confusing.

I think Starbucks is okay...at least some guy in Santa Fe or Taos was going to them OCing a while back.

I eat at IHOP often and have never encountered a sign at any of them. I Have OCed in several in NM and Colorado with no problem as well. As for Denny's, I do not eat there often but I do on occasion and do not remember any signs at any of them. I have only been to a few Starbucks, so I am not really up on them, but I went to one in Midland, Texas a while back (to buy a travel mug) and it was not posted.

Hey guys I live in Albuquerque, NM. I just moved here about 6 months ago. I'm from Massachusetts and only used to concealed carry so haven't open carriedin this state yet. But I can check outany spots in Albquerque if you guys want to post anything I'll go check the places out and see what happens. (I should also have my concealed permit soon.) I've only seen about 2 people open carry here that I didn't know. It seems like most of the locals here don't even know about the open carry law...

So far I'll go check out the Village Inn Restaurant.

Joeddox,

Welcome to the forum! Just saw your post.

I am up here (Rio Rancho, NM) right now for Christmas visiting my sister (I'm online right now at the new Flying Star restaurant -- all the Flying Stars herehave free WiFi -- at Paseo Del Norte and Wyoming in Albuquerque). Didn't notice any signs posted here at this particular Flying Star, nor do I know what their corporate policy is, posted but will have to look again.

...just got up and went over to the entrance: I see no signs of any kind re: anything about firearms. Haven't asked the manager for their OC policy though...will ask as I am on the way out.

Still don't know about Village Inn''s (on Rio Rancho Blvd., across from Intel and next to the new Starbucks) OC policy...don't know about that Starbucks' OC policyor Albuquerque Starbucks in general, either.

Merry Christmas,

Well, I'm back from my trip to the ABQ area, so an update:

As per my last post above, I talked to the Flying Star manager...but he seemed to get scared as soon as I mentioned the subject and nervously checked me out to see if I was carrying. He said no guns allowed there and I said he needs to have that posted. He also was clueless about it being LEGAL to OC in NM. Seemed to be a typical ignorant frightened liberal.

Said he'd ask the owners about their firearms policy but if it's up to said manager, no way. And the owners probably are liberals, too.

So it doesn't look good for ABQ's Flying Stars being anything except a gun-free zone with no security for patrons whatsoever.

FYI-
Flying Stars are licensed to dispense alcohol, therefore it is illegal (4th degree felony) to carry there. No sign required. Be Safe,

RogueAussie ,

Did you see any "no-guns" signs posted there yet (Wyoming & Paseo del Norte location) by said frightened liberal manager?

After my visit there December 24th, I expected they'd be up the very next day.

Maybe you could call their main oiffice and find out their policy and post their response here...

-- John D.

P.S. I usually go to the Flying Star on S. Rio Grande, but like the new one Wyoming & Paseo del Norte area because it has several businesses I frequent: Bank, restuarants, coffeeshop and supernarket...all I really need in one place! And the Starbucks next to Smiths across the way is my favorite.

I also like Flying Star's "Satellite Coffee" place out there on Alameda and Coors Blvd./Corrales Rd...but if Flying Stars get posted, so will Satellites.

Here is an up to date list of the Flying Star cafes that are licensed to serve alcohol:

License #: 30141 Expires: 6/30/2008 Name: FLYING STAR CAFE Owner: FLYING STAR CAFES, INC [line] License #: 3845 Expires: 6/30/2008 Name: FLYING STAR CAFE MENAUL Owner: FLYING STAR CAFES, INC. [line] License #: 3880 Expires: 6/30/2008 Name: FLYING STAR CAFE JUAN TABO Owner: FLYING STAR CAFES, INC. [line] License #: 3928 Expires: 6/30/2008 Name: FLYING STAR CAFE CENTRAL Owner: FLYING STAR CAFES, INC. [line] License #: 3939 Expires: 6/30/2008 Name: FLYING STAR CAFE RIO GRANDE Owner: FLYING STAR CAFES, INC.

Unfortunately, this list does not have addresses where the licenses are in effect, but by the name you can get most of them. Heres a great resource to hove in order to comply with NM's stupidest carry law:

http://www.rld.state.nm.us/AGD/LicenseeSearchFacilities.asp

And remember, the NM Supreme Court ruled that not knowing an establishment is licensed to serve is not a defense. Be safe out there

Thanks for the details. The manager didn't know that either I suppose.

Well, guess it's back to me doing the usual...

So, maybe we should have here a list of Albuquerque eateries/coffeeshops that are NOT off-limits to OC people...those not serving alcohol or having alcohol licenses, and who are friendly to the gun issue and don't discourage OC people. I believe IHOP is one.

The Taos thread names a few restaurants...but how about ABQ and Rio Rancho?

RogueAussie,

It proabaly would be too hard (lots of time and effort) for one person to find out, but I was just thinking that people reading/posting here in the NM area could post names of restuarants/coffee shops that they KNOW are OC-friendly.

In that way, we could make up a list from those "reports."

BTW, did you ever get your .45ACP ammo issue resolved?
