OCing in the Boise Towne Square Mall?

Based on some other threads I've read I was wondering as to the legality of OCing in the Boise Mall.I have OCed in there twice before when I went into Borders Books and several times when I went into Old Chicago Pizza and Pasta andhave never had a probblem with LEO's. I have also never seen a sign that said that OC was prohibited. That being said, I am still curious as to how the mall works for OCing. Is it up to the indiviual stores or the mall as a whole to impose a policy? Also, does the mall count as a public place or is it a private orginazation? Any thoughts would be great. TY!

The Boise Mall is private property. As such, they can post signs or simply ask you to leave. The individual stores are rented space and are treated as seperate private properties.

Failure to leave when asked (when signs are not posted) can result in an arrest, but usually the responding officers will only ticket you on misdemeanor trespassing charges. If you leave when asked (or leave to disarm when asked), no charge can be brought against you.

If it is posted and you enter, you can be held for trespassing. You will be arrested.

What happens if it is posted, you enter, are stopped and you just say you didn't see the sign(s)? Do they let you go?

I'm wondering if "you will be arrested" by the policeif you just say you didn't see the signs. (If there are signs posted.) Or will the police just let you go?

If the police are answering a "man with a gun" call, and the Mall's security has not approached you, you can say, "Sorry officer, I didn't see any sign," while you are leaving. No harm no foul.

The one thing that I believe is prudent every where, you do not argue your case on the streets. You will not win. Argue in Court.

Spoke with security at the mall today and confirmed that the Boise Mall is a 'weapons free zone'

However, there are no signs posted anywhere as far as i could tell and several stores that have entrances directly to them from outside would be able to make their own policy. In addition, I have not actually seen in writing the policy that the security officer stated so I can't say for certain that it exists.

Long story short... If you carry at BTSM and someone sees you, you are gonna get asked to put it in the car. So either carry concealed or be prepped to be detained by LEO's.

Also remember, the mall does not have inhouse security, they go through Allied Barton, and the officer probably will just guess based on what he has seen in the orders at that and other sites. also, most companies use a generic set of orders that they then modify for the site. this means he may have orders for no weapons allowed even if the owners don't feel that way. On the other hand, if the issue has come up before, he may have direct orders to the effect of what you were told.
