Hello,

I have a sister who lives out there and has a DWI. What are her chances of passing a background check, and/or, is it legal for her to own a firearm in Hawaii? Also, can she get a Handgun permit with the DWI on her record?

looking at the Hawaii police departments website, it appears DWI is not a disqualifier, however, if your sister happens to be in counseling for alcoholism as a result of said conviction then it would make her ineligible for a permit.... that is permit to purchase, licenses to carry are never issued. however the recent Peruta ruling should apply there.

Thank you, my wife wants to get her a rifle and/or pistol and wasn't sure about if her sister could own them. However I wasn't sure if anyone had any experience or advanced knowledge. I can read a law and google it, it doesn't help me if someone interprets the law differently than I do. Since I am not very familiar with HI law considering I live and travel in the NV region mostly, I was asking here.

I would not put Hawaii as the second worst firearms state. Aside from the asinine permit process and complete disregard of the 2nd amendment in regards to the right to carry, it is relatively lax compared to many other states. The recent ninth circuit decision may have a positive affect on the pending Baker v. Kealoha case which if it goes in our favor could result in Hawaii being forced to issue carry permits, but it will certainly not happen without a fight from the liberal lawmakers and police.

If you get her a handgun she will need to take either a hunters education class or NRA handgun safety class beforehand. Neither of those are needed to get a long gun permit. I don't think that having a DUI will result in a permit denial but I don't know the specifics of the case. Personally I believe if you get a DUI you are clearly not responsible enough to drive a car and should not own a gun either but that's not what you are asking. If you ask this question on the 2ahawaii.com forums you will likely get a more decisive answer as I would imagine there are members there to whom this question would apply

Okay, aside from the that whole 'complete disregard for the Second Amendment' thing,
  • and the fact that Hawaii is a 'may issue' (and in practice 'no issue') State,
  • and the long gun and handgun permit to purchase,
  • and the long gun and handgun license to own,
  • and the long run and handgun registration,
  • and the fact that one cannot openly carry a long gun (nor a handgun),
  • and that there are no 'peaceable journey' laws,
  • and the handgun magazine limit laws,
  • and the handgun 'cosmetics law' banning certain features,
  • and that carrying an unloaded, cased, firearm in your car is illegal unless it has accompanying paperwork and is going only to one of 6 enumerated places.

..... how is it lax? And what other states are worse?

Well in regards to you list you do not need a "license" to have a firearm. Only a permit to acquire and then it must be registered. And you also do not need to have any paperwork with you when you are bringing your firearm to any of the "approved" places. Since carry is not allowed the places you can take it is pretty pointless because those are the places you would ever take one anyway.

Don't get me wrong here. This place completely sucks for gun owners and I hope the whole damn sh*t hole of a state sinks to the bottom of the ocean but at least we don't have things like restrictions on buying ammo, AR15 mags limited to 10rds... and except for the so called "assault pistols" we can own almost any firearm we want. Massachusetts is one state that immediately comes to mind that is worse in some regards...

The stupid permit to acquire is a pain in the ass but its not impossible. Overall the state sucks for gun owners though. Primarily lack of places to actually shoot.

ha! a new term... assault pistols rock. you should get one. My buddy just finished a 7.5" pistol build with that sig brace. It's a blast to shoot and loud as a cannon (ok ive never heard a cannon but it's really loud)

I do have one back in Maine, A ruger 22 charger. Couldn't bring it to hawaii because it is an "assault pistol"

It would seem common sense and intelligence are not a pre requisit to being a politician
