Request the info again, this time only the official department memo stuff, not any of that spam contained in the e-mail chain. Also, pose a question regarding the intoxicated folks can't possess a firearm as it relates to the actual statutes. It seems that everything past the second comma in RSMo 571.030.1(5) is ignored. Also, how do they square 571.030.1(5) with 571.030.5. What is the "policy" as it relates to private property.

Is there case law regarding the entirety of 571.030.1(5)? Any legal beagles out there?

Im gunna pose this question to my state rep and the future senator. I'll let ya know what the response is.

I am not sure about after the comma or how any of this relates as far as private property I always thought you could OC on your own property regardless of any laws but I am again not fully educated in all the laws. I did dig this up on the statues i do not now if this well help solve any questions.

To me it seems the KC city council has not really done anything to change the ban law they put in effect legally. I am not sure a "memo" to the KC MO PD telling them to ignore it is the same as taking the law off the books by whatever process that entails to become compliant with the SB656 law.

They did change the ordinance on 10/9 to make OC legal with a CCW permit. Apparently they didn't tell the police force...

Sorry, my fault. Too many topics and no delineation.

Ask for the department policy again without that e-mail crap. The stuff discussed in the e-mail should be in their official policy by now. E-mail don't mean nuttin...if ya know what i mean.

Then, ask about their policy on how to handle intoxicated OCers (not recommending it) are handled based on the language of RSMo 571.030.1(5) which added a bunch of language in 2013.

Bottom line, tell the cop shop and the city attorney that they need to "inform" the city fathers that their city codes are not in compliance with state law and as such are risking hefty legal consequences. Spam them with e-mail first. If no acceptable response inform them that they will be reported to the State AG for their unlawful acts via the enforcement of unlawful laws.

The KC PC and the mayor had a lovefest/hatefest campaign specifically against 656.

So, it's not hard to imagine how his mind might work.

(As he rubs the handle of his own gun.)

"Guns are bad... Open carry is bad. This new law is a PITA, but we'll have to be careful and figure out the right way to handle it. We have to stop anyone with a gun as usual. Sheesh, this law will make it more hassle. What's the best way to comply with this thing while we crack down more than ever on open carry?"

He might want to check with Chief Dotson and Mayor Slay since both have come out and stated amendment 5 makes it legal (not 656 guys) and that they don't like it and think it is a bad law bla bla bla but it was CONFIRMED today, OC is good to go, state wide, no permit.

Oh yeah, Slay did add that "it was a little confusing at first but it is legal" during his photo op with mommies demanding attention.

IMO a plain reading of the MO Constitution prior to Amend 5 already made OC a right and it was only MOSC judicial activism that negated it. So, in my mind, A5 just strengthened the previous language to return to the original intent.

What will be interesting is what MOSC does with A5. It already flipped the bird to the original plain language and we know judges are not averse to torturing constitutional language for their personal agendas.

LMTD I am sorry I missed the part were Slay confirmed OC With OUT CCW was legal according to Amendment 5. Was that done by Slay verbally or by STL PD not arresting anyone or CCW checking anyone? Thanks RenZ
