sorry if this is a little unrelated, I didnt know where else to ask. I am trying to determine the legality of discharging a firearm at a beach I know somewhere south of Dover near south bowers. As far as I know, this beach does not belong to anyone. People sometimes fish there in the summer, but not many. This beach has no name. There is simply a road with some houses on it that eventually comes to an end at this beach. The beach is probably over a mile away from the houses. Along the road, there are signs posted that say No Hunting. Ive seen people shooting there before, and there are always shotgun shells about the beach. Any info on this is greatly appreciated.

Trust me: the beach does belong to someone. I'm not aware of any property in DE that has NO owner... Plus, just because you've found shells there and people shoot there doesn't necessarily mean it's lawful to do so... let me look up the area you're talking about... hold on...

Is it south of South Bowers, past the mobile homes at the end of Bennets Pier Road?

If it is, that's probably part of the 3000 acre site owned by Delaware Wildlands, Inc.

Whether that's the right place or not,I doubt they'd appreciate people shooting guns on their property, partially because it may be a wildlife sanctuary type of place, AND for liability purposes, and there may be a "discharge of firearms" restriction listed in that city's ordinances.

Let me know exactly where this is, and I'll get you the owner's name and you can try to get in touch w/ them...

OK, I guessed it right! Whoo hoo....

Anyway, whether you go north or south of the road (along the beach), it's owned by the same entity (Delaware Wildlands). I really doubt that they'd be fine w/ anyone shooting guns on their property, especially being next to the river.It's a liability issue for sure. And if it's a protected lands zone of some sort, that's a big mess waiting to happen.

Contact them AND research the ordinances about discharging firearms thereso you don't get in trouble.

Just my 2¢.

I was looking at the delaware code and all I could find was laws regarding discharge of firearms in parks, across roads, and places like Wilmington and Newark.

all local municipalities can restrict the discharge of weapons, and many are not online. that being said, it is probably not in city/town limits and Kent county codes and ordinances would apply
