Someone with the Henderson Police (female) called and left a message that I am to bring the firearm in to the Lead Street station, unloaded, in a box (a felony), to register it.
I'm thinking I will just ignore the call.

It would be fun to send a NORA request to the Lead street Station, and inquire how many firearms they have registered in the last 12 months.

Nope, they left no contact info. I'm guessing it was not a cop but a clerical type. They called and told my daughter in law to tell me to bring the firearm in for registration.

Hopefully they will push it and this can get before a court.

I'd call them out on it. They won't make the effort to get you to register it, they will simply just arrest or whatever you if they find the unregistered gun. Send another letter, call them back. School them on it. I'm going to have to follow-up with the library because they are ignoring me.

MAKE them answer.

The thing that gets me about these stupid ordinances, is that it's no big deal for the city attorney to say to the council, "Hey, we gotta do a little housekeeping." Boom, done, everybody's happy. I don't understand why it's that hard to change things so that everything is proper.

And don't any of the electards read these kinds of websites?

The point is I have complied with the city ordinance. There is no "schooling" them on it as they already know what the law is. They simply choose to ignore it. Arrest me? I hope so, as that's the point of this exercise.

I'm thinking I should also send registrations to the chief for all the firearms I have that are registered under "blue card" as they are technically in violation of city ordinance. Maybe all of us in Henderson should send the Chief registered letters of registration for all the firearms we have that are currently registered under "blue card" and let them sort it out.

  • All MOU's with other departments, including the Sheriffs and Chiefs association regarding handgun registration.
  • Records showing the number of firearms registered into your Departments registration library.
  • Records showing the number of firearms registered by your Department that are cataloged into another Department's registry.
  • All administrative notices, that concern firearm registration circulated by your Department in the last six months.

How about, "How many firearms have been SEIZED as a result of non-registration?"

"Of those, how many were returned to their owner, and how many were tied to other crimes?"

Since I have heard no more from the City of Henderson, I think I am going to send mail to the C.O.P. registering all of my handguns that are already registered with the county. Technically they are unregistered under Henderson City code and I certainly want to be in compliance with the law don't I?

I think it would be great for anyone in Henderson who has "blue card" registered handguns to do likewise. Just send a registered letter stating Your name and address, your firearm make and model, and the serial number. If you have multiple handguns, send info on all of them. Just let them know that you have discovered city code. 8.98.030 and you wish to be in compliance. Don't mention that they are registered under "blue card". Let them sort it out.

I was wondering the same thing since I spend more time in Henderson than I do in the county or LV.

Henderson Municipal code 8.98.030:
It is unlawful for any person to own or have in his possession a gun, pistol, revolver or other firearm capable of being concealed without first having registered it with the chief of police.
(Ord. 67, § 3, 1954)


According to the wording it means everyone. However, state preemption modified it for them as the city attorney agrees it did. In order for it to apply to anyone other than a resident of Henderson, that person would have to remain in the city for more than 60 days.

has also been wiped out by state preemption (the city attorney agrees) as a resident has 72 hours under state law to register.

Therefore, the only part of the ordinance that has not been wiped out by state preemption is that a resident of Henderson must register with the Chief of Police, period. No where does it define what registration entails. Nor does it give the Chief the authority to use the registration laws of another jurisdiction in place of city code. The county has NO authority within the confines of the incorporated City of Henderson, nor do the Henderson Police have the authority to enforce county ordinances. If they did, they would not charge under the city ordinance as they have done in the past, and would charge under "blue card," which they don't.

If you live in Henderson and you do not register with the C.O.P. you are in violation of city ordinance. However if you were cited for violation of city code, they would have to show that they have a system in place to register those handguns, which of course they do not. It is why I sent a letter of registration to the C.O.P. so that I could show a good faith effort to comply with city code even though there is no system in place to carry it out.
