FLAGSTAFF - A 62-year-old retired teacher who won a new trial after being convicted in the shooting death of a hiker is being released from state prison Tuesday.

Harold Fish was being held at the Lewis prison in Buckeye.

His attorney, Lee Phillips, says Fish will return home to Mesa with his wife and seven children.
Fish claimed he acted in self-defense when he shot Grant Kuenzli in May 2004. He was convicted, but a state appeals court overturned it and ordered a new trial.

Prosecutors decided not to retry Fish because of the appeals court decision and a new self-defense law that retroactively applies to Fish's case.

The new law shifts the burden of proof in self-defense claim cases from the defendant to the prosecutor.

If it was that way at first he never would have served a day in jail. I wonder what state the ones on the jury came from to start with? It happened in the most liberal county in the State. Bet in here in Yavapai county it would never have gone to trial

I'm so glad he is out! I heard it this morning on NPR news and it gave me a huge relief. I couldn't imagine what he went through when that happened to him... Especially when the justice system turned against him. now he gets to be with his wife and family after 3 years of time with real heartless killers. Hope he is doing well.

For those of you who vote, and it should come as no surprise, despite Fish being released, our Attorney General is apparently not happy about it:

"Attorney General Terry Goddard is pushing the case to the Supreme Court."

If you remember anything at the polls next time, please remember Goddard's apparent attitude toward gun owners and self-defense.

This bit really gets me. The Extreme Left, self-proclaimed (faux) champion's of The People's freedom, were never upset about the fact that, until just now, guilty until proven innocent was the rule of the land....

And they can't provide but one sentence to underscore how much they think it sucks that someone might be considered innocent until proven guilty....
