"Gun rights, even in New Jersey" by Eugene Volokh - Washington Post Article

"Gun rights, even in New Jersey" by Eugene Volokh - Washington Post Article

Good article in the Washing Post by Eugene Volokh on the how Michael McGovern eventually got his Firearms ID Card despite Jersey City requiring extra paperwork and documentation. He fought it and won.

The Firearms ID is needed to buy long guns including air rifles, and black powder muskets. A separate "Permit To Purchase" is needed to buy each handgun and there is a limit of one handgun per month.

What is especially good about this article, it sheds light on the onerous, draconian, ridiculous, antiquated process in New Jersey to buy a simple rifle...to a national audience.

Perhaps some intrepid reporter who sees that article will have the nerve to ask Chris Christie why gun rights are so bad in New Jersey and if that is his idea of what 'gun rights' should be if he were the president. Wonder what his response would be? (Christie, is the governor of NJ and is seeking the Presidency if anyone didn't know....)

"The bottom line: “We conclude that a remand is necessary for reconsideration of McGovern’s application with the proper burden of proof placed on Jersey City to prove he is not qualified — in other words, that good cause exists for denial of his application — and without regard to McGovern’s lack of cooperation as to his application except with respect to the Florida arrests.” Presumably at that point McGovern would have the opportunity to actually fill in the information about the arrests. The court also followed past New Jersey case law rejecting the argument that “good character and good repute,” and “the interest of the public health, safety or welfare” were unconstitutionally vague."

unless he has advocated changing the law, he is indeed very happy with the law(s).

So, he advocates all the BS in NJ and would also likely support federal BS that's similar (or worse).

No amount of staples will change the fact that he is a fat pig.

Gun rights in New Jersey...now that is funny. If New Jerseytonians wanted gun rights they would have them...other than the various ethnic mobs who regularly exercise their RKBA regardless of the legality.

People in NJ have the same gun rights as any other state resident ~ its just that they allow the state to oppress them.

The NJ Constitution revised in 1947, gives no reference to the US 2A.... Non whatsoever. How is that even possible?

NJ/NY are the biggest anti states in the country.

Maybe back in 1947 there was a thought that the NJ constitution did not need a reference because the US constitution has the 2A.

@dm: Are you trying to be obtuse?

I came across these images of FID Cards and want to know if they are real or something someone made up for an article. If these are the actual FID's I want to put them on the NJ Page at www.handgunlaw.us Thank you for any assistance you can give Handgunlaw.us in this matter.

No Gary, they are fake except for the third one. FID cards in NJ do not expire. That's how I know the other three are fake.

Thank you. I thought the Drivers license ones were fake. The photos made me think that also. But have seen some permit/licenses images that have similar or even more funny faces for the photo. Knew someone from NJ would know for sure as they have one.

The person who was responsible for pushing through the 1966 FID law was NJ Attorney General Arthur Sills. Mr. Sills also testified in the infamous "Dodd Gun Hearings" in 1965. Thomas Dodd as most of you are aware, is main person responsible for pushing through the 1968 Gun Control Act. So with Sills helping Dodd testify in the hearings, perhaps in a small way has a hand in helping draft the 68 GCA.

After NJ came up with the Firearms ID Card scheme 1966, Illinois saw what NJ did and started their own ID card law in 1968 (FOID). Massachusetts saw what NJ and Illinois did and soon followed with their own FID law in 1969.

Bad things start in New Jersey....

The infamous "Hughes Amendment" which shut the NFA registry for new machine guns in 1986...was written by New Jersey Democrat William J. Hughes.

If anyone is interested in the history of NJ Gun Control. Check out these two articles I wrote some time ago.

OMG!

Does anyone have Mr. Volokh's e-mail address? Someone needs to tell him that RIGHTS don't involve applications and paying fees to various governmental entities.

Correct, in NJ there are no gun rights. Just some implied permissions within a very narrow range of exemptions.
