Ahh the age old state agency preemption issue. Hopefully we can get this resolved despite McAuliffe's political tactics, and perhaps the will of the people shall finally be acknowledged.

They want to search you. Nope, I don't think so. Search is not administrative in nature but part of criminal searches.

You'll have a good 4th amendment case.

Regulations banning concealed firearms have entered the Final stage of adoption. The Department of General Services has issued a statement responding to the 4,791 comments it received. Responses of note:

"The Supreme Court has held that the 2nd Amendment allows restrictions on firearms in sensitive places where people congregate and are most vulnerable, such as government buildings. Accordingly, this regulation does not place an undue burden on any rights under the 2nd Amendment."

"These regulations are authorized by the Code of Virginia, §§ 2.2-1100(B), 2.2-1102(A)(1) and 2.2-1129(B), Executive Order # 50 (2015), and the Constitution of Virginia."

"The agency appreciates the comments supportive of the regulation."

There is one more opportunity for public comment, not that it will dissuade the policymakers. At this point, I think it's clear that the regulations will be removed only through litigation or the election of a new governor.

I believe that was Dicta, not a ruling. (Dicta is merely opining by the Supreme Court and is not actually a part of the ruling.)

In which case that begs the question - can one be legally/properly charged with trespass for not leaving an ABC store or DMV facility when so instructed? My understanding is "Yes."

I won't be a test case, because why would I want to A) occupy a government agency building for no reason because B) I'm not giving my money to anyone who discriminates against me.

I've entered an ABC store twice since the EO was issued. The first time nothing was said so I continued with my purchase. The second time I was asked to "put my weapon back in my vehicle," so I left and haven't been back since. I was OC both times, obviously.
