@ 5:45 they will have their legal analyst talk about the case and the "open carry law"

at 6pm they will have a reaction from the jury

Fox 2 spoke to jurors at six who said they didn't agree with OC but they followed the law!Imagine that! 2 of em said the legislature should re-visit the law! It all came out right despite anti-OC jurors! This IS the USA after all!!Thanks Sean!! CARRY ON!

yeah, but at 5:45 on their "legal analysis" segment they really botched it imo. of course they named all the places you can't OC without a cpl, but never mentioned the cpl exemption to those places.

Sean M. Combs is only 18 but he already knows more about civil rights and Michigan gun laws than the officers who arrested him in April for carrying an antique M1 Garand rifle slung over his shoulder.

The two officers, Rebekah Springer and Gina Potts, saw Combs carrying the rifle in Troy Michigan and demanded his ID. When he refused, noting that he was not violating any laws, he was arrested and charged with Brandishing, Disturbing the Peace, and Obstructing an Officer.

I have written before about the misuse of these “catch-all” charges to chill the rights of citizens and this case appears no different.

+1, this was an important case and i'm happy you let us discuss it here.

the one thing that kinda disappoints me is he was asked if he planned to continue to OC and said not right now. obviously that is his choice, but it kinda gives the impression that what he did was wrong, even if not illegal.

john, good article. i know you say at the bottom of your article that the isreali pic isn't relevant, but it does show that LGOC or OC in general is perfectly acceptable in the most mundane situations in other parts of the world. switzerland would be another example (even though their OC is primarily or maybe solely militia)

I would guess his attorney told him to lay low until after all the legal is done, including civil action. I doubt it will be the last of this young man's OCing. Hopefully the police return his rifle promptly.

the news said the city hasn't said whether they will appeal or not, so they are keeping his rifle for now.

How in the heck can they appeal a not guilty! That would be double jeopardy, the only thing they can appeal is the judges ruling on the charge dropped, and I doubt they get anywhere with that. And the obstructing charge has nothing to do with the rifle, they are stonewalling, or just being babies.

I saw that as well. :( I think he was really shaken up by the experience and just wants some time to recover. As mentioned by others, I also think his attorney is having him play it cool for now.

In the comments, part of your reply to another commenter was, "I don’t know that the officer’s actions went far enough to see him recover under 1983 unfortunately."

I don't disagree with you. But I do believe the officers' should at least taste the salty tang of anxiety in their mouths that only a legal document naming you as defendant in a civil rights violation case can give. It should give them, and their fellow officers, a bit of pause in the future when dealing with perfectly law-abiding citizens.

Like so much about our justice system, the deterrent effect is of equal consideration to actual punishment of offenders.

I know you neither took a position for nor against a civil suit. This is just to put my view out there. I advocate that civil suits be liberally applied to officers, in any situation in which it is probable a civil rights violation occurred. If only for the deterrent effect alone.

Congrats to Sean on the verdict. Having never been in that defendants seat myself I can just imagine the range of emotions he has gone through. For anyone here to advocate that he bring suit himself for redress of their wrong doing is a streach for us because ONLY HE can deciede that , and it also takes money to do that. He's 18 and probably doesn't have much in the bank, like some of us 'older' fellas here. When the time comes I'm sure we can all find some extra change to donate to that cause should it come to pass. Sure, I would sue them in a heart beat if it were me, I have the money and the time to invest, and I will pony up something for his suit if he wishes to bring one, and I hope others will too.
