The story as linked does not mention whether or not he had a license to carry. The story also does not mention whether the crime charged involved not having a license, just that he was arrested for concealed carry.

It is a reasonable assumption that he was arrested because the arresting authority believed him not to be licensed, but at this point in time, I must say honestly that I don’t know whether he was licensed and whether the charge involves a lack of a license.

However, I saw nothing on the video that justifies waving a gun around.

Where do you see that he didn't have a permit? I did not read that my man.
Sorry eye95, et al., do your own research as now LEs are discussing hate crime charges stemming from the MLK day incident.

[here eye95, a boon: quote City of Miami Police confirmed to 7News that Bartlett was arrested and charged with carrying a concealed weapon without a permit. Unquote https://wsvn.com/news/local/man-arr...-yelling-racial-slur-at-cyclists-in-brickell/ ]

The title should be:
Arrested for carrying a concealed firearm WITHOUT A LICENSE in Florida

It's is illegal to open carry in Florida.

That's not the case. As has been covered in the FLA forum many, many time, there are activities in that state where OC is protected. I was camping there just this past weekend in Navarre and OCed the entire time.

Gee-wiz I didn't know that, NOT.....
My statement was general in nature. I have commented a number of times about the stupid open carry for hunting, phishing and camping exception.

So georg, the firearm incident mentioned in the OP’s cited article occurred on a fishing pier or in the immediate camping area where you were this past weekend?

Did i cover all the places where it is legal to OC georg?

Oh My Goodness georg...lookie what Handgunlaw.us says about FL’s OC, quote:

Open carry is not legal in Florida. [hummm georg, isn’t this what CoL indicated?]

790.053Open Carrying of Weapons.
(1) Except as otherwise provided by law and in subsection (2), it is unlawful for any person to openly carry on or about his or her person any firearm or electric weapon or device.

(2) A person may openly carry, for purposes of lawful self-defense:
(a) A self-defense chemical spray.
(b) A nonlethal stun gun or dart-firing stun gun or other nonlethal electric weapon or device that is designed solely for defensive purposes. Unquote http://handgunlaw.us/states/florida.pdf

"You just ran over me; you just ran over my foot" is obviously mental. She walks away from the scene without even a hint of a limp. Making a mountain out of a molehill.

Pink shirt man brandishing a firearm... I see no reason to brandish a firearm, do you?

"He ran over my foot!" Still mental. Still not limping.

Pink shirt cussing up a storm... While brandishing a firearm... Not exactly the proper non-LEO way of managing an angry crowd. Wouldn't you agree?

There are currently 1,784,395 CC permits in Florida, higher than in any other state. How can someone be "arrested and charged with carrying a concealed firearm?" Of course, that's only IF he had a CC permit. If not, well, I didn't exactly see evidence of CC, did you? Does car carry constitute CC in Florida?

Pass 2 through the video... Did I miss anything?

Oh... When did they decide to name this protest, “Bikes Up, Guns Down?" Was it AFTER the event??? Were they in possession of a lawful permit issued by Miami prior to staging the event?

Regardless, the video clearly shows "The group of boys and young men were blocking traffic on the Brickell Avenue Bridge."

Were THEY charged? Last time I checked, about six months ago, it's illegal to block the flow of traffic in ALL 50 of these United States. So... Were they charged? If not, why WEREN'T they charged? After all, the PRECIPITATED the incident.

And were they arrested or charged for protesting without a permit? Creating a public nuisance?

LOTS of details missing from this CBS "news" gaggle.

Since9, could you, per forum mandates, provide a unequivocally viable cite(s) for your pontification about ‘illegal’ in ALL states of this great UNION?

I’ll wait....

[sidebar, ps...called prosecutorial discretionary judgement!]

This from the guy who literally said, “Do your own research.”

That being said, and while the guidelines do tell us to cite to authority, I personally don’t care that he did not (and suspect that few others do either). If such behavior is not illegal in any State, it should be. The Rights of many people to travel are being denied, and that is the sole excuse for ceding authority to government: to keep us from trampling on each other’s Rights.

Also, st some point, “prosecutorial discretion” becomes “blatant disregard for lawbreaking”. The local cops not breaking up this activity has clearly crossed that line.

Well eye95, could you perhapes articulate, what guidelines as well as what behaviour should be illegal, i am sure it would be helpful to readers of this forum.

Are you referring to Since9’s recent forum behaviour of pontificating statements of, “...illegal...in ALL 50 of...” w/o cites so member’s might assure they remain lawful or some other illegal behaviour?

I personally have not experienced, over the last five years during my 8k road trips or extensive air travel, any type of denial throughout our great Nation.

So any clarification on examples of what behaviour should be illegal would be quite appreciated.

FL318 provisions...
(1) Except as provided in ss. 318.17 and 320.07(3)(c), any person cited for a violation of chapter 316, s. 320.0605, s. 320.07(3)(a) or (b), s. 322.065, s. 322.15(1), s. 322.16(2) or (3), s. 322.1615, s. 322.19, or s. 1006.66(3) is charged with a noncriminal infraction and must be cited for such an infraction and cited to appear before an official. If another person dies as a result of the noncriminal infraction, the person cited may be required to perform 120 community service hours under s. 316.027(4), in addition to any other penalties.

Basically, nada !
[tho glad nobody died, the 120 community service hours could be untenable!]

So since9’s question is valid and still looms: “Were they charged?”

Blocking public streets instigated the confrontation. Government liberals will not pursue criminal or civil penalties for those shown in the video blocking the streets.
