army corps of engineers barren river lake control the campgrounds

my brother in law is camping and fishing at barren river state park, he has invited me and my family to go with him but i was told i couldn't even have a gun locked in my car while at the campsite. i called barren river park and the man i spoke to said i could carry in the park except where the A. C. E. control, which is now not only the dam and spillway but the campgrounds too, my wife contacted them and she was told that no weapons are allowed in the camp area, not even locked in our car. so we won't be camping at barren river park anymore, thought i would pass this along. we haven't camped there in about 7-8 years but the last time we did there were no signs against firearms at the campgrounds but now there are.

Yep, on any lands/waters under the control of the Army Corps of Engineers (ACE), firearms and ammunition are strictly prohibited via 36 C.F.R. § 327.13 (except that one place where the courts decided otherwise).

There is a bill in Congress and several civil suits making their way through the court system to change that, however.

Many of the lakes in Ky were constructed by the ACE. Then, after they were completed, the surrounding grounds were leased by the state for the purpose of constructing a state park. The state does not own these parks, it only leases the land. Barren River is only one of the many State Parks that are run like that. Who would enforce these bans on firearms for the ACE? Have you seen any FBI agents or US Marshalls running around the parks, checking for guns? Most of us have been ignoring these gun bans for many years without any proplem. Nobody knows exactly where the line between the ACE authority and the state authority is. I doubt that anyone connected witht he parks is going to enforce any gun ban, but proceed with caution. What is the penalty for violating the ACE ban?

It's just a misdemeanor...and criminal record.

§ 327.25 Violations of rules and regulations.
(a) Any person who violates the provisions of the regulations in this part, other than for a failure to pay authorized recreation use fees as separately provided for in § 327.23, may be punished by a fine of not more than $5,000 or imprisonment for not more than six months or both and may be tried and sentenced in accordance with the provisions of section 3401 of Title 18, United States Code. Persons designated by the District Commander shall have the authority to issue a citation for violation of the regulations in this part, requiring any person charged with the violation to appear before the United States Magistrate within whose jurisdiction the affected water resources development project is located (16 U.S.C. 460d).
(b) Any person who commits an act against any official or employee of the U.S. Army Corps of Engineers that is a crime under the provisions of section 111 or section 1114 of Title 18, United States Code or under provisions of pertinent state law may be tried and sentenced as further provided under Federal or state law, as the case may be.​

I try to post whenever I see any changes anywhere, I wish others would. those campgrounds were under state law last time i was there but now there not, but maybe congress will get the bill passed to end the ban. I also read online that in several states one being Idaho or Iowa that the A.C.E. weren't going to try and enforce the bans but I don't remember reading anything about KY. The article was about president Trump stopping the gun bans on state and federal lands.

On April 17, 2015, federal defendants filed their opening brief. On July 8, 2015, Ms. Nesbitt and Mr. Baker filed their answer brief. On August 12, 2015, the Corps filed its reply brief. On March 3, 2017, on the eve of oral arguments before the Ninth Circuit in Seattle, federal lawyers filed an emergency motion stating their clients’ intention to ‘reconsider[] the firearms policy,’ which the panel granted.

GeorgiaCarry.org has a similar lawsuit working its way through the courts and a bill, H.B. 1045 is in the US Congressional hopper.

It wouldn't be the worst thing in the world if the USACE was forced to defend their regulation in each state or district of the nation. Divide and conquer and all that, right?

We have had this problem in VA at Philpott reserve also. I had pictures of anti rights sings on the roads around the lake. I went to the damn one time and they were covered in anti rights signs.

They have took down the ones on the roads. I have not been to the dam in years, so i dont know about that area. Just like the post office the federal government really hates the consitution
