My state is not a stop & identify state. I carry sterile when on foot. Sure he could run my tags, but who is driving the vehicle?

Ask ID equals insult

Anytime a police officer asks you for an ID they have just insulted you. Simply because there is no reason to see ID of law abiding citizens whether carrying or not. If an officer wants an ID it means they are either fishing, or insinuating you have done something wrong, and need to submit to a search. That is what an ID request is, it is a search. We are protected from such a search in NC due to US V Black.

Everyone who posted today gave their advise/opinion/personal experience regarding the scenario offered. I grew up in a family of Police Officers. Giving a cop guff was not even in my play book growing up.
I can truly say that I was schooled today. I don't have to agree with everything that's posted here but if I wish to be part of your community I will pay closer attention.

While we can appear gruff at times ourselves, overall we are a patient and tolerant bunch. We not only practice what we preach, we educate.

We'll support by whatever means you chose to carry: OC, CC, or noC. Just do nothing to supplant our right to determine how we accomplish that.

I am a former Academy Instructor. My son is the senior use of force instructor for a very large state agency. We both encourage people to OC.

My GF and his wife were interviewed on NightLine in 2008 along with Philip van Cleve (president VCDL), John Pierce & Mike Stollenwerk (owners of OCDO) and other defenders of the faith.

To answer this specific question---- Anytime a person acquiesces to any request made by a police officer that exceeds the lawful authority given to that officer by law and / or violates the constitutionally protected rights of one in the United States we all have our Constitutionally protected rights violated.

By the "willingness" of the citizen to comply with the demands made; the officer is encouraged to escalate and continue to violate our rights because no one objected. Then the officer begins to expect that his requests made under color of law will be followed. Then demands that these unlawful demands be complied with. Finally when they are not the officer many times escalates those same demands and the violation of the individual's Constitutionally protected rights! Even the statement of "if you have done nothing wrong you have nothing to hide" weakens us all. The standard is NOT if you have done nothing wrong, the standard is "innocent until proven wrong".

It is not my responsibility to prove to the good officer that I am "legal" it is up to the officer to first have RAS as a minimum to even impeded me in whatever I am engaged in when he demands I engage with him. I don't care if it is a policy of the department that he get the name, address, SSN, explanation of my actions for the agencies "field interview database"--- His compliance with such a policy is a requirement of his employer---- It is a violation of my rights for him to demand such info from me when he has no RAS or Probable Cause to believe that I am now, about to engage in, or have previously violated some law.

Being stopped and showing your ID will NOT get you on your way,,,
as fast and safe from illegal hassles as simply saying,,
No Thank You, then just go on your merry way!

After all, if the cop really thinks you broke a law,, He WILL Forcibly Detain you!!
No reason to be soooo polite that you allow yourself to Detain yourself..

this is not a contest capt, but rather you have, per se, been brainwashed to believing a different set of values which was ingrained in your perspective for your entire life.

the majority of forum members have no open animosity towards the nice LEs ~ IF the nice LEs remember their place in the communal society which is comprised of LACs not BGs. LACs do not have to be watched and controlled and did i mentioned watched constantly.

Well, not being in law enforcement I may not have the best answer to that so I'll defer to the experts. Tell ya what, next time an officer asks for your identification when he has no suspicion of illegality, go ahead and ask him for his. Ask him where he sleeps at night, where his wife and kids are when he's not home. I'll likely echo his response.

Anecdotally, one might look at the experiences of Brett Darrow. After he filmed a suspicionless stop by an officer, other cops began to stake out his home, one on CopTalk user repeating the address wrote, "Every copper, City and County, should etch this little punks [sic] name in their [sic] memory. Brett Darrow, [address deleted], city of St. Louis."

I must be getting slow. While the quote above was not exactly the original question, its close enough. Close enough to finally recognize the unstated premise as a misdirection. A little embarrassing, actually.

Misdirection question: "What's the harm in giving the officer your ID?"

Correct question: "Why is a cop demanding an identity document without lawful authority? As in, why is a cop exceeding his authority?"

We all know--from years of reports, voice-recordings, and FOIA releases--that cops don't request an identity document. They demand it. Even when the words they utter are polite, the tone of voice makes it clear it is a demand. So don't nobody bother to argue that the cop is only asking, or only requesting. It is almost always demanded in a tone calculated to induce compliance.

It is not law-abiding citizens who need to explain why they want to exercise their rights. It is the compliance advocate who needs to explain why he thinks it is acceptable for cops to make extra-legal, and in many cases illegal, demands.*


Remember Brown v Texas--cop has to have genuine RAS before demanding identity.
