Early last year. I posted the audio from the encounter in a thread.

I'll search for that thread...maybe they have received the proper training since then. Have you OC'd there since? If not, it might be time to zoom them again. Don't give up, go up (the chain of command). Walmart corp. policy, I'm sure you already know, is to follow state law.

I OC there a couple of times a week while I'm out searching for ammo. When did they do that to you?

I remember that one. Hopefully they followed up on it and gave their department the proper training. I was able to search through Des Moines' city records online and saw they had a suit involving that officer (Beveridge v. WalMart Stores, et al., Polk County No. CL 100141), but I haven't been able to get my hands/eyes on the actual proceeding of the case. From the financial records authorizing payment to the attorneys' office representing him it looked like he cost them quite a bit of money. Other searches for officer Christopher Huffman haven't really turned up much other than his LinkedIn profile and the occasional/expected reports of him doing his job (seemingly) correctly.

Luckily here in Spencer, the Loss Prevention person knows the laws as well as WM's policy. I quizzed her when I was hired. AND she follows it too.

I had a fellow come into the Sporting Goods section one day and he was OC'ing his empty holster. I asked him where his gun was and he said in the car. I then asked him why? As he began to answer (fear of getting kicked out or cops called) our LP person happened to walk into the dept for something. I said to the customer that I would prove it to him - asked her right then and she just said YEP - it is cool.

THAT'S the way it should be!

Granted he could still get the cops called on him by an "ignorant(of the laws)person but that is always a risk - UNFORTUNATELY.

Visiting Iowa

Well, not really visiting... I work for a company that monitors state contracted crews during disaster recovery. Good chance I'll be flying out to Iowa very soon.

I'm from Connecticut and I'm an OCer, everywhere I go. I'm reading up on Iowa laws but I thought you guys could give me some info on OCing in Iowa.

What's the law on carrying around schools, on school property? (seems to be different in every state) In CT, you can't carry (CC or OC) within 1000 ft. of a school without a permit. With a permit, you can carry right up to the property line.

https://www.legis.iowa.gov/DOCS/ACO/IC/LINC/Chapter.724.pdf

Multiple things to try and understand:

724.4A Weapons Free Zones - Enhanced Penalties.

1. As used in this section, "weapons free zone" means the area in or on, or within one thousand feet of, the
real property comprising a public or private elementary or secondary school, or in or on the real property
comprising a public park.
A weapons free zone shall not include that portion of a public park designated as a
hunting area under section 461A.42.

As you can see above, schools are covered in the Iowa law. I had this same question because I drop someone off at a school now and then. The exceptions below gave me the only option to keep my weapon close (not left at home).

724.4B Carrying Weapons on School Grounds—Penalty—Exceptions.

1. A person who goes armed with, carries, or transports a firearm of any kind, whether concealed or not, on
the grounds of a school commits a class "D" felony. For the purposes of this section, "school" means a
public or nonpublic school as defined in section 280.2.

#1 directly above states the penalty for for carry on school grounds BUT #2 below states the exceptions which will keep you from breaking said law

2. Subsection 1 (the part that says you are breaking the law) does not apply to the following:
a. A person listed under section 724.4, subsection 4, paragraphs "b" through "f" or "j".
b. A person who has been specifically authorized by the school to go armed, carry, or transport a
firearm on the school grounds, including for purposes of conducting an instructional program
regarding firearms. 95 Acts, ch 191, §53

The letter a (above) is how I can have a weapon on school grounds (NO I still can not have it on my person). You have to reference 724.4, subsection 4, paragraphs "b" through "f" or "j" to see if they can give you an out. They are listed below:

724.4 Carrying weapons.
.......
4. Subsections 1 through 3 do not apply to any of the following:

a. A person who goes armed with a dangerous weapon in the person’s own dwelling or
place of business, or on land owned or possessed by the person.
b. A peace officer, when the officer’s duties require the person to carry such weapons.
c. A member of the armed forces of the United States or of the national guard or person
in the service of the United States, when the weapons are carried in connection with the
person’s duties as such.
d. A correctional officer, when the officer’s duties require, serving under the authority of
the Iowa department of corrections.
e. A person who for any lawful purpose carries an unloaded pistol, revolver, or other
dangerous weapon inside a closed and fastened container or securely wrapped package which
is too large to be concealed on the person.[/B]
f. A person who for any lawful purpose carries or transports an unloaded pistol or revolver
in a vehicle inside a closed and fastened container or securely wrapped package which is too
large to be concealed on the person or inside a cargo or luggage compartment where the
pistol or revolver will not be readily accessible to any person riding in the vehicle or common
carrier
..........
j. A lawenforcement officer from another statewhen the officer’s duties requirethe officer
to carry the weapon and the officer is in this state for any of the following reasons:
(1) The extradition or other lawful removal of a prisoner from this state.
(2) Pursuit of a suspect in compliance with chapter 806.
(3) Activities in the capacity of a law enforcement officer with the knowledge and consent
of the chief of police of the city or the sheriff of the county in which the activities occur or of
the commissioner of public safety[/B]

IANAL but as I understand the law and its exceptions, "I" can have my weapon on school grounds IF any of b-f or j apply to me. The only one which I can currently use is letter f:

f. A person who for any lawful purpose carries or transports an unloaded pistol or revolver
in a vehicle inside a closed and fastened container or securely wrapped package which is too
large to be concealed on the person or inside a cargo or luggage compartment where the
pistol or revolver will not be readily accessible to any person riding in the vehicle or common
carrier

Although, as I read "e" this could possible let me carry in the school???
e.......for any lawful purpose carries an unloaded pistol, revolver, or other
dangerous weapon inside a closed and fastened container... which
is too large to be concealed on the person.

This could in theory let me carry (albeit unloaded) into the school in something like a briefcase/computer bag.

Don't know if this helps or makes things more confusing. All I know is that I believe I am legal using the laws exceptions.

In short, with a permit you may not carry on school grounds, but the "weapons free zone" around the school means nothing at all, it is merely a penalty enhancer. You may, however, carry on school grounds in the same manner which would be legal for a non-permit-holder to carry anywhere (unloaded, cased, and fastened, as mentioned above).

So I ate at the Huhot in Sioux city again while open carrying my pistol. This time the experience wasn't so positive. After I ate, paid my tab, and headed for the exit the manager stop me and ask me to not bring my pistol in the next time I come to Huhot because a few a his customers complained about it. I ask him what is Huhot's policy on guns and he said there isn't one, and that he was only requesting that I didn't bring my gun into Huhot anymore. I kindly told him that I would not feel comfortable going to any business that would not let me carry my firearm. He said thats ok then thanked me for coming and I left. I might just conceal next time I go there to prevent any further issues. Or just keep open carrying there until they ask me to leave.

Burlington....

So, I spent most of the day today open carrying around the Burlington/North Burlington area. I was just running a bunch of errands with a friend. Carried at Lowes, Applebees, and numerous other stores. Even went into Burlington City Hall. Not one comment. Not one officer. Had a great day!

In your case, it matters not what the state says about the 1000' zone. Federal law [18 USC 922 (q)(2)], also know as the GFSZ Act, requires you to have a concealed carry permit issued by the state the school is in. A CT permit in invalid everywhere outside of CT, for federal purposes. Admittedly, it is exceeding rare to be charged for this without some reason to have already been cited for some other unlawful action.

I am not a lawyer. To my knowledge, there is nothing in the Iowa code that prevents someone from carrying someone else's gun.
